Freiman Pushes Bill To Allow Permanent Outdoor Dining, Alcohol Sales

SOMERSET COUNTY, NJ — A bill to permanently allow outdoor dining and alcohol sales for restaurants, bars, distilleries, and breweries has closer to becoming a reality in New Jersey.

Bill A4866, sponsored by Assemblyman Roy Freiman (D-Hunterdon, Mercer, Middlesex, Somerset) cleared the Assembly Oversight, Reform and Federal Relations Committee on Thursday.

"By giving restaurants and similar businesses the opportunity to extend their services outdoors, we are helping them thrive in a post-pandemic world while fostering lively, community-centered outdoor spaces," said Freiman. "This bill will provide a much-needed boost to local businesses and create more inviting spaces for patrons to enjoy."

During COVID-19, the New Jersey Division of Alcoholic Beverage Control issued a Special Ruling that allowed restaurants and bars to establish temporary outdoor locations.

Subsequent legislation extended the expiration date of this rule until Nov. 30, 2024. The bill advanced Thursday would allow restaurants and bars to permanently extend their premises to outdoor locations.

"This is a win all around," said Freiman.
