'Insufficient Evidence' in Fatal Crash Involving Dosing Driver, Prosecutor Says

Lake Hopatcong resident Charles Castglione will not face criminal charges in May accident.

A Lake Hopatcong man will not be criminally charges by Sussex County for falling asleep behind the wheel and crashing into the vehicle of a woman who ultimately died from her injuries last May, NJ.com reported.

Sussex County Prosecutor David Weaver made the announcement Thursday, noting that there was "insufficient evidence" to charge 54-year-old Charles Castiglione. The man was facing charges of reckless driving, failure to keep right and careless driving after dozing off and colliding with 62-year-old Hamburg resident Conchita Fried while driving on Route 23 north in Franklin, the article said.

The prosecutor said Superior Court Judge N. Peter Conforti signed an order sending Castiglione's summonses back to Franklin Municipal Court.
