Millburn ‘Nanny Cam’ Invasion: Cop Accused Of Racial Slurs Won’t Face Criminal Charges
Prosecutor: A Millburn police officer accused of using racial slurs on the scene of a high-profile home invasion won't face criminal charges
MILLBURN, NJ — A Millburn police officer accused of using a racial slur and other derogatory terms while on the scene of a high-profile home invasion and beating in 2013 will not face criminal charges, authorities announced late Friday.
Prosecutors said that Millburn Detective Colin McMillan was filmed using the racially charged language on a home “nanny cam,” which also showed the attacker - an African-American man - beat the woman who lived in the house and throw her down the basement stairs in front of her three-year-old daughter.

Millburn Detective Collin McMillan, who is white, can reportedly be heard saying racial slurs three times in the video. At one point, McMillan allegedly referred to the attacker as a "monkey."

Another Millburn police officer who was there, Andrew DelRusso, said he did not recall hearing McMillan say the slurs at the time and said in court it was "completely shocking" to hear it captured on the nanny cam.

“It was determined that McMillan’s comments, which were captured on the nanny cam, did not rise to the level of criminal conduct,” the Essex County Prosecutor’s Office stated Friday.

The investigation has been returned to officials in Millburn for consideration of administrative charges, prosecutors said.
