How can the citizens of Parsippany fail to remember the “betrayal” of their own community in the waterview episode, where the last of the Hills of Troy were bulldozed and deforested for the now additional mall so-called waterview marketplace? Although citizens filled Town Hall and School auditoriums; in resistance and witnessed former Mayor Barberio promise in front of hundreds of people that this unwanted/unneeded land destruction would not take place, that “we will have our open space” RD Management LLC developed it anyway.
This sleazy deal worked out with our former conflict of interest and pro developer attorney John Inglesino in direct conflict with the grassroots outcome. Included also a payment in local open space funding over $4.7 million to the developer for a 9.26 acre buffer called open space. (Could have been zoned as a nonstructural stormwater landscape component for Troy Brook, at no costs to anyone)
The waterview landscape was a Rutgers Study recognized sensitive landscape of steep slopes, trees and grade A soils best for groundwater recharge, all ignored. NJ Highlands Land Use Capacity maps also sited this area as best for preservation; especially in light of Parsippany’s water deficit, and past failures to protect it’s water recharge areas.

Mayors Job is not

The former Mayor saw himself as some job creator and over-zealously supported the developer against his own community. A mayors job is to make sure his municipal workforce are performing their duties and responsibilities, not support private interest against his own community. This changed the character of the Intervale immediate neighborhood for no just cause and most likely further injured the groundwater recharge phenomena of the aquifer our wells depend on.

The former attorney was finally exposed for his falsehoods especially in relations to Highlands Conformance and its possible benefits to Parsippany. (this can be viewed in a Youtube video for all to see December 18, 2018 A rebuttal of the misleading information given by former Parsippany-Troy Hills municipal attorney John Inglesino at the June 17, 2014 Township Council meeting, to convince Council members to rescind the conformance process with the Highlands Regional Master Plan).
Attorney Inglesino removed Parsippany from Highlands Conformance in July 2014, all based on falsehoods, and with full consent of the then Republican Council. Ask: If Parsippany is 100% in the Highlands Planning Zone what was feared? Corporate developers would be required to have an ecological responsibility, and perhaps spend more to benefit all.

So we in fact were not being governed by our then Mayor but by his attorney and the power he was representing. Despite Councils vote to remove him; he stayed with full approval of Barberio.

Budget Gimmicks or Financial foresight public trust?
Recently Councilwoman Peterson asked what is the difference in using funds for water/sewer or from any other source for purposes not intended? (In this case our Water Sewer Surplus verses COVID funds in the 2021 budget shortfall). In short the answer is violation of Public Trust. A doctrine established in Roman times and what every official is or should be bond to.

Water is Life
The state serves as a trustee to maintain the trust or common resources for the benefit of current and future generations who are the beneficiaries. Just as private trustees are judicially accountable to their beneficiaries, so too are state trustees in managing public trust properties. Our water infrastructure system through age, use, consumption and depletion, now requires these funds. for example Parsippany needs 4-more wells, pumps, motors, and updated water infrastructure.

Our water sewer surplus was raided for political budget gimmicks Water is a Public Trust. We now need monies for the degraded water infrastructure, and loss of 4-wells. The cupboard was bare.

Oh; and thank you Mayor Soriano for returning us to Highlands Water Protection and Planning Act. If not for the last administration this already would be in effect and perhaps have made certain situations now facing us less threatening.
