Assistant Prosecutor Mariam Qudah argued before Superior Court Judge Paul X. Escandon on Monday that Smith should be held until trial but Escandon permitted Smith to be released until trial, the prosecutor's office said in a tweet Monday evening. Escandon required among other conditions that Smith be placed on home detention with electronic ankle bracelet monitoring, have no contact with the victim or his family, and not operate a motor vehicle, the prosecutor's office said.

Smith is a former agent with the Internal Revenue Service who had been assigned to Secret Service details, including protecting former presidents George H. W. Bush and Bill Clinton, according to a report in the Asbury Park Press. The report said her attorney, John Perrone, said Smith followed the boy after he got into a fight with her husband after the boy came to try to pick up the couple's 20-year-old daughter.

Smith’s case remains pending presentment before a Monmouth County grand jury. In addition to the attempted murder charge, she faces weapons charges, prosecutors said last week. According to the Asbury Park Press report, Smith had a 4-inch pocketknife in her pocket and after hitting the boy with her car, backed up to talk with him and tried to get him to come over to the car while she patted the pocket containing the knife.

Smith is accused of hitting the boy with her car in the area of Central and First avenues in Wall shortly after 7:30 p.m. on April 30, following the fight. The boy was taken to Jersey Shore University Medical Center in Neptune for treatment of non-life-threatening injuries and later released, Gramiccioni said.
