Man Found Guilty in Death of Man Run Over by His Own Stolen Car to be Sentenced

The 48-year-old man was convicted of murder charges last month.

A Manhattan man found guilty on charges involving the death of a man who was struck and killed by his own car while trying to stop the man from stealing the car in North Bay Shore in 2014 will be sentenced on Wednesday.

Last month, 48-year-old Edwin Gutierrez was convicted on two counts of second-degree murder; one count for committing the crime with “with depraved indifference” and the other charge for committing the crime of murder during the commission of another felony – auto theft, according to the Suffolk County District Attorney.

He was also convicted of first-degree robbery and third-degree attempted grand larceny, the DA said.

In November 2014, Dionel Ramirez, 69, of North Amityville parked his Hyundai in the parking lot of the 7-Eleven on 148 Pine Aire Drive and left the car running with the door open while he was at the store picking up excess food to bring to a soup kitchen, police said.

Gutierrez then entered his car and attempted to drive away, police said.

Ramirez attempted to stop Gutierrez, who then ran him over with the Hyundai and fled the scene in the stolen car, police said.

Ramirez was pronounced dead at Southside Hospital in Bay Shore.

At the time of his arrest, Gutierrez was also charged with first-degree robbery and third-degree attempted grand larceny, police said.

He pleaded not guilty to the charges in December of 2014. He is due back in court on Sept. 7.
