He was already suing her.

Former NYPD psychologist Emily Dearden has been indicted for the attempted murder of her husband in November 2013.

She will be arraigned on the murder and other charges in Westchester County Court on May 14, according to the Westchester County District Attorney’s Office.

The shooting occurred in their Yonkers home and was first attributed to an intruder. The New York Post wrote that the lawsuit states that Emily shot him in the back of the head while he slept.

Dearden is alleged to have had an affair with a Texas man, Warren David Roudebush, and to have shot her husband to be with him.

But Dearden’s lawyer, Paul Bergman, speculated to The Journal News that Kenneth Dearden filed the lawsuit which precipitated the criminal charges because Emily Dearden had filed for divorce in August 2014. Bergman told TJN reporter Jon Bandler that his client would be exonerated once all the evidence was out.

Dearden was suspended with pay from her job with the NYPD, according to news reports.
