Westchester City Judge to Resign Post in January Due to Misconduct Allegations

Yonkers City Judge Robert C. Cerrato began his tenure in 2001 and was slated to serve until 2020.

Yonkers City Judge Robert C. Cerrato has agreed to vacate his judgeship, effective Jan. 1, 2016, following allegations of misconduct, announced the New York State Commission on Judicial Conduct.

Cerrato was accused of improperly contacting “third parties on behalf of his daughter regarding incidents arising from the matrimonial dispute between his daughter and her then-husband,” and also overcharging to officiate weddings outside of Yonkers. He charged $200 per service when fees are stipulated to be $100.

“The public interest has been served by the result in this judicial disciplinary matter and the open manner in which it was resolved,” said Commission Administrator Robert H. Tembeckjian in a statement. In addition to vacating his position, Cerrato also promised he “would neither seek nor accept judicial office at any time in the future.”

The Journal News reports that Cerrato made the calls involving his daughter’s divorce between the fall of 2011 and spring of 2012.
