A & P Sues Buyer of Millwood Store

The buyer was unable to complete the sale because of roadblocks from the landlord

A&P is suing the company that bid on its Millwood store during the series of auctions in which the bankrupt grocery chain divested itself of assets.

The uncompleted transaction has left the town of New Castle without a grocery store.

The Millwood A&P went to Ruben Luna, owner of Key Foods and C-Town. He transferred his buying rights to a company owned by his brother Jamie Luna, Millwood Merchant, LLC, according to the Chappaqua Daily Voice.

The landlord of the shopping center in Millwood of which the A&P is the anchor store had demanded extra financial assurances from the Lunas.

P. Daniel Hollis, attorney for the landlord, told Tom Auchterlonie of the Daily Voice that A&P was still paying rent.
