Garden City Approves Apartments At 555 Stewart Avenue

The board approved the 150-unit apartment building, but did place some restrictions on it.

On Wednesday, the Garden City Board of Trustees approved a plan to build a 150-unit apartment complex at 555 Stewart Ave.

The board approved a permit submitted by 550 Stewart Avenue Acquisitions, LLC to build the complex. However, it is a special use permit and has a list of restrictions: units cannot be combined, the developer must provide insurance, the maximum number of units cannot exceed 150, the developer needs site plan approval by the Board of Trustees, and more.

The developer has nine months to obtain site plan approval and then another nine months after that to obtain building permits. Construction will only be allowed for 15 months after the first building permit is issued.

Under the federal court order which resulted from the federal fair housing case decided in April 2014, the village was required to consider and act upon the application. The village could not, as a result of the court order, merely respond to the application citing the prior zoning of the property. The adopted local law will require a maximum plot area no less than three acres but not to exceed five acres; a maximum permitted Floor Area Ratio (FAR) not to exceed 0.99; a minimum plot area not less than 1,290 square feet for each dwelling unit; a maximum building lot coverage not to exceed 27 percent; a maximum building height not to exceed four stories nor a height of 45 feet; and a minimum front yard setback not less than 10 feet.
