DA: Unlicensed Doctor From Sands Point Sold Xanax, Adderall to Patients for Cash

A former doctor from Sands Point was indicted Friday for selling prescriptions for highly addictive and dangerous drugs to patents for cash, according to Acting Nassau County District Attorney Madeline Singas.

Unlicensed psychiatric Marshall Hubsher, 65, of Sands Point, conspired with a licensed doctor to sell Adderall and Xanax prescriptions to patients in Hubsher’s former Roslyn office, where he continued to see patients after losing his medical license, the DA says.

Hubsher, who was previously charged with third degree rape in 2012, was indicted on the following charges: fourth degree conspiracy and three counts of unauthorized practice.

On at least three occasions, Hubsher would meet with patients in a non-traditional setting, like an office hallway, to ask medical questions and receive cash, the DA says. He would then allegedly direct the patients to Dr. Howard Mahler who would write prescriptions for Adderall or Xanax.

One undercover detective, posing as a patient addicted to prescription pills, told Hubsher that he wanted a higher dose of Adderall in order to sell the pills to fund purchases of Oxycodone, according to the DA.

Hubsher and Mahler were arrested Oct. 29 at Hubsher’s office by Members of the U.S. Drug Enforcement Administration Long Island Division’s Tactical Diversion Group.

Singas said Hubsher behaved with no regard for public safety or any patient’s health. “Prescription drug abuse is all too common in our communities and it is important that we stop bad actors who seek to make illegal profits from their sale,” she said in a statement.

Hubsher surrendered his license to practice medicine in New York in June 2012 to resolve multiple unrelated charges brought by the State Board for Professional Medical Conduct, according to the DA.

Hubsher faces a maximum sentence of 1 ⅓ to four years in prison if convicted of the top charged. Bail was set at $240,000 bond or $120,000 cash.

He is due back in court on Dec. 12 for this case and a rape case from April 2012, where he is accused of having sexual relations with a patient.
