UPDATE: Sands Point Psychiatrist Faces Rape Charges

Doctor pleads not guilty at arraignment.

A Sands Point psychiatrist was arrested for allegedly raping a patient.

Police say Marshall Hubsher of Middle Road engaged in sexual relations with a 32-year-old female patient during a treatment session for depression in his office at 1025 Northern Boulevard in Flower Hill, a violation of New York State penal law.

Later Thursday Hubsher entered a not-guilty plea at his arraignment at First District Court in Hempstead. His wife and a patient were at his side, Newsday reported.

"It's unethical for a doctor to have sexual relations with a patient during a session," said Detective/Sergeant Carlo Maltempi, at a Thursday mid-day press conference at Nassau County Police Headquarters in Mineola.

According to detectives, the incident occurred on Tuesday, April 3, during the woman's second treatment, and that the victim came forward on April 9. A thorough investigation was conducted before charges were made, Maltempi said.

In addition, police confirmed that during the late 1980s, Hubsher's professional license was suspended because of a possession of a controlled substance.

Maltempi would not say if there other victims, only that the "investigation is ongoing."

Hubsher is charged with third-degree rape and third-degree criminal sexual act.

He is represented by attorney Alan Nelson of Lake Success, Newsday reports.
