Man Convicted Of Murdering Ex Outside Harlem Day Care, Prosecutors Say

The man shot his ex girlfriend as she dropped their 2-year-old daughter off at the day care center.

HARLEM, NY — A man is facing prison time after being convicted of killing his ex girlfriend outside of a Harlem day care during a domestic dispute in 2015, Manhattan District Attorney Cyrus Vance announced.

Eugene Miller, 33, was found guilty of second-degree murder Tuesday, prosecutors said in a statement. Miller fatally shot Rosetta Ewell, 30, in a hallway outside their child's day care center on July 24, 2015, prosecutors said.

"Eugene Miller senselessly murdered his ex-girlfriend just steps from the day care facility where their child was enrolled," Vance said in a statement. "The day care staff and children, including the defendant’s own child, were so close to the crime scene that they heard the shots. This gruesome shooting left three young children without their mother. I know this conviction cannot heal the wounds left by Rosie Ewell’s tragic death, but I hope it provides a sense of closure for her loved ones."

Miller hid in the stairwell of the West 139th Street building where he and ex-girlfriend Ewell sent their child to day care on the morning of July 24, 2015, prosecutors said. Miller knew that Ewell would be dropping off their 2-year-old daughter at the day care that morning. As Ewell approached the building elevator, Miller emerged from his hiding spot and shot her twice in the face and once in her head, prosecutors said.

Sentencing is scheduled for June 28, 2017.
