Defendant Charged with DWI Found Not Guilty After Jury Trial

Kings Park man arrested in August 2014; subjected to unwanted publicity; exercised his right to a jury trial; acquitted after 9 day trial!

On Friday, October 30th, I concluded a 9 day jury trial. My client was charged with DWI. The nutshell version is that he was involved in a motor vehicle accident, and immediately thereafter the vehicle he was operating came into contact with a house, causing the house to be condemned while being repaired. 7 witnesses were called by the District Attorney, including 3 police officers, testifying to his “highly intoxicated” state.
The jury rejected the testimony of these 7 witnesses as it acquitted on the DWI count; convicted on the traffic infraction of driving while impaired, most likely due to his admission of consuming 2 alcoholic beverages approximately 3 hours prior to driving.
