Hospital Worker Had Sex With Patient
A resident of such a facility where he worked is not capable of consenting to sexual contact with staff, according to state law.

GOSHEN, NY — An Orange County hospital worker will be going to prison after being found guilty of having sex with a patient at a residential facility where he worked. Orange County District Attorney David M. Hoovler said Jan. 10 that Nathan Oglesby, 57, of Wallkill, Ulster County, was sentenced to four years in state prison and 10 years' post-release supervision.
On Oct. 22, 2018, he was found guilty by a jury of third-degree criminal sexual act, a felony, and second-degree sexual abuse, a misdemeanor.
During the trail, prosecutors argued that Oglesby, who worked as a treatment aide in the facility, had sexual contact with the female patient.

Under state law, a resident or inpatient of such a facility is deemed incapable of consenting to sexual contact with facility staff members, the district attorney said.

The jury found that, although Oglesby did not subject the victim to sexual contact by force, he did commit the two crimes for which he was found guilty, according to authorities.
His sentence of four years was the maximum permitted for those crimes.
"We sought and obtained the maximum sentence permissible under the law for this defendant, who abused his position of trust to take advantage of a hospital patient when the patient was most vulnerable," Hoovler said.
"We cannot allow those who need and seek treatment to be victimized by those who are charged with caring for them," he said.
