Are the TOR and TZXpress drivers being treated fairly by their employer...or was the Rockland County Supreme Court correct in issuing a stay for the binding arbitration that was supposed to end the impasse between the Union and Brega Transport?
According to Court documents the petitioner, Brega Transport could conceivably go out of business if the Union is allowed to use binding arbitration. Well maybe Brega Transport should not have come in with such a low bid. The original bid specification was an RFP, meaning not necessarily lowest bidder, but best value for the County. But Brega Transport did not like that and took the County to Court to have it changed to an RFB, lowest bidder. Well Brega decided to go really low with his bid, the other two bidders were $250,000 of each other ($50,000/yr), nobody I have talked to in the Transportation industry thought he could do it at $6-7,000,000 lower that the two other bidders. Now Brega has the contract and is faced with a dilemma on how to not give the drivers what they had been getting for years from Coach USA and still have a happy creww. The County also has a dilemma, because there is document that puts them on the hook for anything that Brega does not give them.

As was said over and over again, the only way Brega Transport could be $6-7 million lower then the other two bidders would be on the backs of the drivers. The 13C labor clause proved to be just smoke and mirrors and had no teeth to it. The other bidders were going to continue the existing CBA as written and everyone would have been happy. The Legislature against the advise of The Transportation Department and The County Executive decided to pick Brega Transport. It didn't take a fortune teller to see what was going to happen, and it is, and will continue until the contract is over and the County picks a real transportation company. Maybe if they ask Coach USA nicely, they can take over this debacle... the wheels are literally coming off...more to come....
