1-Car Accident Adds up to DWI for West Nyack Man

Clarkstown police found the car in a ditch on West Nyack Road Jan. 5.

Clarkstown police responded to a possible car accident on West Nyack Road in West Nyack at 9:20 p.m. Jan. 5.

The vehicle and driver were found in a ditch on the side of the road. It was a one-car accident with no injuries.

Officers interviewed the driver, John Mortsakis, 29, and concluded he was drunk. He failed field sobriety tests and was taken to Clarkstown Police Headquarters, where he failed a breathalyzer test.

The West Nyack resident was charged with felony DWI, due to a prior conviction within 10 years ( Felony) and with aggravated DWI (misdemeanor).

Mortsakis was arraigned in Clarkstown Justice Court. Bail was set at $2,000. He was released on bail and is scheduled to return to court Jan. 7.
