Briarcliff Manor Court: Larceny and Burglary Cases End with Jail Time

Burglary Case Ends with Jail Time

Andrew Becker, 30, was arrested on Nov. 17, 2010 and charged with Burglary in the Second Degree.

The Bronx resident pled guilty to Criminal Trespass in the Second Degree on Wednesday, which carries a 30-day jail sentence to be completed on weekends. He began his sentence yesterday night at 8 p.m.

Village Justice Fred Weinstein said it appeared Becker had been compliant with all treatment mandates and was "in a position to put this behind him."

He was additionally sentenced to a 5-year order of protection in favor of the female complainant in the case and a $205 surcharge.

Jenkins Matter Put Off One More Time

Jermaine Jenkins, 26, was arrested on Dec. 17, 2010 and charged with Aggravated Unlicensed Operation in the Second Degree and Suspended Registration.

While Assistant District Attorney Diana Ameri previously said the Briarcliff Manor charges  pending against the Sleepy Hollow resident, she said that was no longer the case on Wednesday.

Jenkins' attorney did point out his pending charge in Sleepy Hollow  and the defendant was due back in Ossining court on Thursday.

Therefore, he said he was not prepared to take a disposition this week.

Ameri consented to a July 24 adjournment, but she stated if there is no disposition on that date she would request a trial. Her current position on sentencing is a 30-day jail sentence.

Jackson Remains Incarcerated

Robert Jackson, 62, is charged with Criminal Possession of Stolen Property in the Fifth Degree.

He was arrested on June 30 and remains incarcerated in county jail with bail set at $500.

On Wednesday, Ameri conveyed an offer to Jackson's attorney. She stated if he were to plead guilty to one count of Criminal Possession of Stolen Property in the Fifth Degree, it would carry a 90-day jail sentence and cover two pending misdemeanors in New Rochelle.

Jackson's attorney requested an adjournment date of Aug. 10.

He remains incarcerated in county jail with bail set at $500.

2008 Larceny Case Wraps Up

Robert Fahey, 48, was initially arrested on Nov. 6, 2008 and charged with Petit Larceny. He was accused of taking items from a Pleasantville Road service station.

On July 21, 2009, he was charged with Bail Jumping in Briarcliff Manor.

The Maspeth resident appeared in court in handcuffs on Wednesday, where he pled guilty to the lowered charge of Attempted Petit Larceny and was given a 15-day jail sentence.

TASC Compliance, Prior History Complicate DWI Case

Syed Rahman, 21, was arrested on May 14 and charged with Driving While Intoxicated.

On Wednesday, the Briarcliff Manor resident's attorney said the defendant had a non-compliant Treatment Alternatives for Safer Communities (TASC) report due to appointment conflicts.

He requested an adjournment until Aug. 24, which Ameri consented to.

Weinstein warned Rahman must make an appointment prior to that date and come to court with a favorable report to remain released on his own recognizance.

His attorney also indicated Rahman has previous "impaired" convictions and may seek a jury trial.

The case was adjourned until Aug. 24.

VOP Defendant Makes First Appearance

Shavoyah Murrell, 18, is charged with Violation of Probation.

The Peekskill resident was due in court on July 13, , leading Weinstein to issue a warrant for her arrest.

Murrell appeared in court on Wednesday after surrendering voluntarily.

Her attorney entered a denial on her behalf and stated she had attempted to report to her probation officer the previous day, but was denied due to a pending case in Cortlandt.

The case was adjourned until Aug. 18.

Criminal Contempt Defendant Arraigned

Florindo Volpacchio, 53, faces a Criminal Contempt in the Second Degree Charge in Briarcliff Manor.

He was arrested on Wednesday and was arraigned the same day.

The White Plains resident was then released on his own recognizance.
