Zoning Decisions

Granted: The Estate of Margaret Manheimer, Jamar Lane. Application for a side yard variance for an existing second story wood deck.

Granted: Kristen Bulzoni, St. Joseph Avenue. Application for permission for first and second story residence additions and a front yard setback variance for a proposed roofed over porch of 7 x 36, which exceeds 4 x 8 permitted by the Town.

Granted: Thomasina Cosimo, Lakewood Road. Applicant requested interpretation as to whether the operation of an existing retail masonry supply business is a permitted use in J2 business/C residence zone. Board ruled as follows:

"The Board determined that the applicant's business is a "garden center" within the meaning of Town Code Section 85-227.1. Therefore it is a permitted use by special permit from the Planning Board within a J-2 Business District zoning classification. Extent of the outdoor/outside display of the garden stone and related materials is to be determined by the Planning Board at the special permit review process."
