RIVERSIDE, NY — A Rocky Point man faces upgraded charges in an indictment in connection with a fatal crash on William Floyd Parkway that left one brother dead, and the other fighting for his life, Suffolk County District Attorney Ray Tierney said Friday.

Jonathan Shaver, 51, of Rocky Point, was indicted for leaving the scene of an incident without reporting in connection with his vehicle striking two men who were tending to a disabled vehicle on the parkway last month, according to prosecutors.

One of the men, Edgar Mejia, 31, of Mastic Beach, died at the scene, and his brother, Omar, sustained serious injuries, authorities said.

Shaver was ordered held on $100,000, $200,00 bond, or $1,000,000 partially secured bond during the pendency of the case.

He faces two-and-one-third years to seven years in prison if convicted on the top count.

Patch has reached out to his defense attorney, Del Atwell of East Hampton, for comment.

Tierney said Shaver struck the pair, "who were simply trying to fix a tire on the shoulder of the parkway, and fled the scene without stopping to render aid."

"One victim has died, and the other is fighting for his life," he said. “We owe it to them and their families to pursue justice, and this indictment is an important step in that direction.”

On Jan. 29, at around 6:44 p.m., Shaver was driving a 2012 Honda Accord northbound on William Floyd Parkway, when he struck Mejia and another man, who were both on the shoulder of the road fixing a tire, prosecutors said.

Shaver left the scene without seeking aid for the men or contacting the police, prosecutors said, adding that Mejia died as a result of the injuries he sustained from the crash.

His family has identified the second man as his brother, Omar Mejia.

He was taken to a local hospital, where he is currently listed in critical condition with a traumatic brain injury, prosecutors said.

Video surveillance was recovered near the scene of the crash captured Shaver visiting various establishments in the Shirley area before the crash, and investigators obtained footage showing his vehicle after the crash traveling northbound without a passenger-side headlight, according to prosecutors.

Suffolk Police tracked down his Honda Accord parked in front of Shaver's home with front-end damage, and he was arrested, and his vehicle impounded as evidence, prosecutors said.

Shaver is due back in court on March 10.
