Drunk Driver Passes Trooper At 94 MPH: Police

He was going 94 mph in a 55 mph zone, police say.

SOUTHAMPTON, NY — A Valley Stream man was arrested after he drove 94 miles per hour on New York State Route 27 and passed a New York State trooper, police said.

According to New York State Police, Phillip Lilavois, 27, was arrested on Sept. 1 after he was caught going 94 miles per hour in a posted 55 mile per hour zone while heading west; Lilavois merged from the left lane into the right lane and passed a New York State trooper who was out on another traffic stop with his emergency lights activated, police said

Lilavois was stopped by the trooper for speeding and also for failing to move over for an emergency vehicle that had its emergency lights activated, police said.

While the trooper was interviewing Lilavois, the strong odor of alcoholic beverage was found to be emanating from the vehicle and, due to the defendant's verbal admissions and his performance during his standardized field sobriety tests, which were indicative of being intoxicated by alcohol, he was placed under arrest, police said.

Lilavois was transported back to New York State Police barracks Riverside, where he provided a breath sample of .06% BAC and was charged with driving while ability impaired by alcohol, police said.

Lilavois is due back at the Suffolk County First District Court on Oct. 23, police said.
