Inside the Sleepy Hollow Courthouse: Llerena Will Get 90 Days, Moore Has Charges Reduced

Llerena Argues Against 90-Day Sentence

Daniel Segundo Llerena lashed out in court on Monday against the likelihood that he will face 90 days in prison.

Llerena was answering to charges of Criminal Possession of a Controlled Substance in the 7th Degree. He was arrested back in May of 2010 on Cortlandt Street for cocaine possession.

The Sleepy Hollow resident had been going to treatment through the Treatment Alternatives for Safer Communities (TASC) program in the hopes of reducing his sentence, but that did not satisfy the District Attorney's Office, which recommended a period of incarceration due to his lengthy record.

"Record? What record?" Llerena shouted. "Do I have felonies? Do I have any serious crimes?"

Llerena made it apparent that he wanted to get rid of his court-appointed attorney and start his court process over again, but Village Justice Andres Valdespino said the case had already gone on for too long. Valdespino said that Llerena could either accept a 90-day prison sentence being offered by the Assistant District Attorney, or he could go to trial, where a conviction could land him with a year-long prison term.

"If I go to trial, I'll lose. You guys are against me," Llerena said. "You just want me to serve more time."

Valdespino restated to Llerena his options and sent the man off to discuss the issue with his attorney. When he came back at the end of the court session, Llerena had accepted that he would get no better offer than the 90 day sentence.

"It's better to just get it over with," he said.

Llerena pled guilty to Criminal Possession of a Controlled Substance in the 7th Degree. He will be in court next week for sentencing, and to begin his jail time.

Roldan Case Adjourned

Walter Roldan, of 64 Howard Street, is charged with Sexual Abuse in the 1st Degree, a D felony, after an incident that occurred last month where he allegedly touched a 13-year-old girl.

Roldan is alleged to have targeted a young girl who was coming out of a general store on Cortlandt Street. Roldan approached her behind St. Teresa of Avila Church on Depeyster Street and grabbed the girl's chest. According to police, he then exposed himself before the young girl pushed him off and ran away.

Roldan's case was adjourned until next month at his lawyer's request.

Moore Has Charges Reduced

Gary Moore, 35, is charged with two misdemeanors and a violation - assault, resisting arrest and unlawful possession of marijuana.

He was on June 3 after attempting to flee from police. One police officer's wrist was injured while attempting to restrain Moore.

Moore was also seen throwing a cigarette box over a fence at the scene, which K9 units later discovered. The box was found to contain marijuana.

Assistant District Attorney Robert Docherty noted that a disposition had been reached in the case which would allow Moore to plead guilty to Attempted Assault and Attempted Resisting Arrest.

Moore pled guilty and was subsequently sentenced to two consecutive one-year probation terms.

Blacknall Gets New Cases

Dafon Blacknall was in Sleepy Hollow court to answer to new charges of criminal trespassing. He was arrested twice over the weekend for attempting to illegally enter 126 Valey Street.

Blacknall is already facing a criminal facilitation charge for allegedly helping broker a drug deal with an undercover Sleepy Hollow Police Officer.

Blacknall is also charged with Harassment in the 2nd Degree, in Tarrytown.

His court appointed attorney entered not-guilty pleas to the new charges and the case was adjourned until Feb. 28.
