Man Fatally Shot Wife 5 Times, Tried To Kill Himself In Montco: Court Records
A Philadelphia man was charged with first-degree murder after fighting in a car last Saturday night in Rockledge Borough.
ROCKLEDGE BOROUGH, PA — The man accused of fatally shooting his wife last weekend on Huntingdon Pike had become angry towards her at a party the couple attended, fought in the car afterwards, and then fatally shot her five times, court documents state.
Montgomery County Detectives who interviewed Jose Antonio Luna, charged in the shooting of his wife Alisett L. Schubert, said that the couple attended a party at a banquet hall last Saturday afternoon.
Court documents also reveal that Luna had an extensive criminal history, including arrests for robbery, burglary, and grand theft. He was also arrested numerous times for illegal entry into the United States and re-entry after deportation. Those criminal convictions made him a person not to possess a firearm.

Luna, 59, of Philadelphia, said he became angry towards her because she "disrespected him in front of others." Luna told detectives that he had slapped his wife in the back of her neck when he felt disrespected, a criminal complaint states.
Luna said he remained angry with her until the time they departed the party in the Nissan Murano. He said he was seated in the front passenger seat, and his wife was driving the Murano with her purse resting on her right side, the criminal complaint states.

Luna told detectives that he knew his wife kept a revolver in her purse and said the purse was closed. The two started arguing, and Schubert stopped the car in the traffic lane and told Luna to get out of the vehicle and walk home, the complaint states.
Luna stated the two were wrestling over the purse when he took possession of it and placed the purse on the floor next to his feet. Luna said he opened the purse and saw the handgun, the criminal complaint said.
Luna said his wife attempted to take the purse back when Luna pulled the revolver from the purse and shot his wife one time. Luna stated his wife yelled, "Oh my God" and he watched as she attempted to exit the vehicle, the complaint states.
Luna stated he then shot her "four more times," and believed he had one round left in the handgun so he could shoot himself later.
The complaint states that Luna stated he observed his wife lying outside the car unresponsive, and called Schubert's mother, followed by his brother, to assist him out of the area.
Luna stated while he attempted to get out of the area on foot, he was confronted by police and he pulled the revolver from his right pants pocket and attempted to shoot himself in the head, however, the firearm "just clicked," the complaint states.
The complaint states that Luna fled with the gun and his wife's wallet as well.
Detectives also interviewed a woman who was at the party who identified herself as Schubert's best friend, the complaint states. She said that Schubert had confided in her about previous "physical, mental, verbal, and financial abuse" from Luna.
On one occasion, the friend said she witnessed Luna punch Schubert in the face. At the time of the incident, Schubert requested everyone to leave the residence. A short time later, the friend returned to find Schubert standing outside without any clothes on the top half of her body and just shorts on the lower half, the complaint states.
The victim's mother told authorities that she also attended the same party as her daughter and Luna. When she arrived home, Luna had called her to say that Schubert was dead, the complaint states. Luna did not reveal how Schubert had died, but told her mother that he wanted to kill himself.
Luna is charged with first-degree murder, third-degree murder, and possessing an instrument of crime, the Montgomery County District Attorney's Office said.
There is no bail available for First-Degree Murder. Luna was sent to the Montgomery County Correctional Facility. A preliminary hearing is scheduled for 10 a.m. on March 5.
