East Greenwich Chiropractor Ordered To Repay Nearly $74K After Medicaid Fraud Sentencing

The chiropractor submitted false and fraudulent claims to Neighborhood Health Plan of Rhode Island, the attorney general's office said.

An East Greenwich chiropractor was ordered to repay nearly $75,000 after pleading no contest to medical assistance fraud.

In addition to paying $74,878.03 in restitution to the Rhode Island Executive Office of Health and Human Services, Mark Breiding, 58, was hit wth a six-year suspended sentence with six years of probation, according to a media release from the Rhode Island Attorney General's Office.

"Additionally, Judge (Kevin F.) McHugh ordered the defendant to surrender his license with the Rhode Island Department of Health and banned the defendant from receiving any further payments from Medicaid and Medicare," the release said.

Breiden also agreed not to reapply for his chiropractor license in Rhode Island, according to the department of health.

Prosecutors were prepared to prove that "Breiding submitted false and fraudulent claims to Neighborhood Health Plan of Rhode Island for its patients insured by Medicaid throughout 2020," the release said.

"Investigators found that (Breiden) overbilled Neighborhood Health by 'upcoding' procedures, billed for services excluded under his contract with Neighborhood Health, exceeded yearly limits on patient visits, submitted bills for services that exceeded 24 hours in a given day, and performed chiropractic services to minors without contractually required pediatric referrals," according to the release.
