Report: Charges Downgraded in Fatal DUI

Robert Craft's charges lowered to DUI 2nd offense. Authorities have determined that the stricken vehicle also contributed to the fatal crash.

Robert Craft of Pelion was not totally at fault , a South Carolina Highway Patrol investigation has revealed. 

As a result, Craft's original charges of felony DUI involving death will be downgraded to DUI 2nd offense, according to this report by WIS-TV.

A detailed analysis by the determined that the driver of the vehicle Craft hit turned in front of Craft, who then hit the vehicle, killing 7-year-old Cameron Upchurch. Cameron's 10-year-old sister, Haley, died a few days later from injuries in the crash.

The report also confirmed that Craft was legally drunk but driving under the posted speed limit at the time of the crash, WIS reported. MAIT ruled that both parties contributed to the crash. 

The vehicle carrying the victims, driven by their grandparents, was turning into a private drive off South Lake Drive near Red Bank when the crash occurred.

Craft is scheduled to be in court on Feb. 6. He has been in the Lexington County Detention Center without bond since the accident. 

The Upchurch children, who were returning home from church with their grandparents when the crash occurred, were students at Saxe Gotha Elementary School in Lexington.
