UPDATE: Friendswood Police ID Man Killed In Officer-Involved Shooting.

Investigators said officer was trying to arrest Cummins who reportedly was stealing beer when the shooting occurred.

FRIENDSWOOD, TX -- Police have identified the man killed by a Friendswood Police Officer Tuesday as 55-year old Toby Cummins, of California.

Police responded to the 100 block of South Friendswood Drive around 3:10 p.m., after receiving a call that a man had taken beer from a nearby convenience store without paying.

The officer confronted the man, now identified as Cummins, who allegedly was armed with a box cutter.

According to a KTRK report, witnesses reported seeing Cummins walking away from the officer, who reportedly chased after him, drew his weapon and fired.

Investigators said an officer was attempting to arrest a man, who’d reportedly walked into a convenience store and walked back out with beer without paying.

Police investigators have not indicated if the suspect, who still has not been identified, resisted arrested or attempted to harm the officer.

The officer involved in the shooting was not injured.

Friendswood Police Chief Bob Wieners said details about the incident would be withheld until a preliminary investigation was complete.

The suspect in the case was taken to Clear Lake Hospital where he was pronounced dead.

Police are asking the public to avoid the area.
