Family Of Toddler In Other Fatal Fall From High Rise Is Suing
The family of the 3-year-old who died falling from a window filed a lawsuit after another toddler died at the same building.

Following news of a second fatal fall of a child at Skyline Towers in Bailey's Crossroads this year, the family of the first victim is suing the property.
The wrongful death lawsuit stems from the May fall of a 3-year-old boy from a window at the apartment building. The boy had been with family members when he fell from an open, screened bedroom window. He was taken to a hospital and pronounced dead.
After a second toddler fell from the building and died Monday, the family was motivated to go forward with the lawsuit, according to WTOP. The 2-year-old fell from a balcony as an adult caregiver was tending to another child, Fairfax County Police say.

The family seeks $100 million from the building owner and the property manager. Meanwhile some residents of the building expressed concerns about the distance between rails on the balconies and locks on windows, NBC4 reported.
Kim Brooks-Rodney, a lawyer for the 3-year-old victim's family at Cohen & Cohen, told WTOP the property reportedly knew about the safety concerns of the windows. She said there should be warnings for families on the window screens.

"It’s to bring about awareness; we don’t want another child to die," Brooks-Rodney told WTOP about the lawsuit.
The investigation into the 2-year-old's fatal fall Monday is ongoing. Building owner Equity Residential spokesperson told the news station it will work with police on the investigation.
