Mailbox Knocked Over, Neighbor Dispute Over Basketball Hoop, Credit Card Fraud at Local Store: Crime Report

VIENNA POLICE HIGHLIGHTS November 27, 2015

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from November 20, 2015 – November 26, 2015. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

Some reports may be outside the date parameters due to extended investigations or other circumstances. Some cases are not included at all due to ongoing investigations. INCIDENTS

Bad Check 15-011373 Sheets Whole Sale 430 Mill Street, NE October 10 12:00 p.m. An employee reported a female customer had written a check for the purchase of materials. The employee stated the check was later returned by the bank for insufficient funds. He made several attempts to contact the customer to discuss the check but she had not returned his calls.

This case is being investigated.

Petit Larceny 15-011234 The Cedar Lane School 101 Cedar Lane, SW November 13 9:15 a.m. A student reported someone had taken her wallet from her purse.

Fraud 15-011305 200 Block Park Street, NE Between November 18 at 11:38 a.m. and November 19 at 7:00 p.m. A resident reported she was contacted by her credit card company and informed her credit card account had been frozen due to suspicious activity on the account. She stated on November 2, 2015, she received a shipment of portable radios she had not ordered.

This case is being investigated.

Destruction of Property 15-011232 900 Block Westwood Drive, NE Between November 19 at 5:00 p.m. and November 20 at 9:23 a.m. A resident reported her mailbox had been knocked from its post.

Open Door 15-011224 Epiphany United Methodist Church 1014 Country Club Drive, NE November 20 3:35 a.m. An alarm company reported an alarm had been activated at the church. PFC Tracy responded and located an unsecured door. The interior of the church was searched and nothing appeared to be out of place.

The door was secured prior to leaving.

Suspicious Event 15-011238 600 Block Kearney Court, SW November 20 9:15 a.m. A resident reported she had been having on-going problems with her neighbor. She stated she had a basketball hoop, near the curb by her house, which the neighbor had removed by a Town of Vienna Sanitation worker.

Officer Hylinski responded and spoke with the neighbor who stated it was a misunderstanding and she would make amends with her neighbor.

Mental Case 15-011248 The Vienna Police Department 215 Center Street, South November 20 2:00 p.m. Officer Hylinski responded to the Vienna Police Station to speak with a resident who reported her in-laws had stolen rugs from her residence, while she was being treated at a local hospital. The resident requested the addresses of local shelters. After receiving the information she left the police station.

Arrest – Drunk in Public 15-011254 The Vienna Inn 120 Maple Avenue, East November 20 4:20 p.m.

An employee reported she stopped serving a customer who had been in the restaurant and appeared to be intoxicated. The intoxicated customer left prior to the arrival of the police officer.

Officer Hylinski responded to the area and located the individual staggering towards the W&OD Trail. Due to his level of intoxication he arrested the 39 year old man from Cottesloe in Western Australia for Drunk in Public.

He was transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.

Credit Card Fraud 15-011266 The CVS 335 Maple Avenue, East November 20 6:44 p.m.

An employee reported an individual entered the store and attempted to purchase two gift cards with two different credit cards. The employee stated when he requested identification from the individual, to verify the credit cards, he left leaving the gift cards behind.

This case is being investigated.

Lost Property 15-011283 300 Block Ainstree Court, NE November 20 8:00 p.m. An individual reported that after taking a taxi cab from Washington, D.C. to visit a resident in the Town of Vienna she realized she left her wallet in the cab.

The cab company was contacted and stated the wallet had not been turned in.

Arrest – Driving While Intoxicated/Refusal 15-011276 200 Block Maple Avenue, West November 20 11:24 p.m. Officer Post was on patrol when she observed the driver of a vehicle commit a series of traffic violations. As a result of those violations she conducted a traffic stop. Upon her interaction with the driver she detected the signs of possible impairment. After failing to complete a series of field sobriety tests she arrested the 44 year old man from Hill Road in Vienna for Driving While Intoxicated.

The driver was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. Once at the station he chose to refuse that opportunity.

Officer Post transported him to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated and Refusal to Submit to a Breath Test.

Animal Complaint 15-011306 400 Block Center Street, North November 21 4:06 p.m. Officer Tremont responded to the area after a resident reported a barking dog. Upon arriving in the area he located the dog who continued to bark. Attempts to contact the owner were unsuccessful.

ACO Barker will follow up with this case.

Suspicious Event 15-011310 100 Block Patrick Street, SE November 21 7:08 p.m. A resident reported an unknown Hispanic male had followed her home and attempted to gain entry into her mother’s apartment. She stated she believes the man may live in the apartment building next to her mother’s building.

The man left the area prior to the arrival of the police officer.

Arrest – Driving While Intoxicated/Concealed Weapon 15-011313 100 Block Maple Avenue, West November 21 9:26 p.m. Officer Post was on patrol when she observed the driver of a vehicle commit a traffic violation. As a result of that violation she conducted a traffic stop. Upon her interaction with the driver she detected the signs of possible impairment. She also discovered the driver was in possession of a concealed handgun and knives. The driver informed her he did not possess a concealed permit for the handgun.

After failing to complete a series of field sobriety tests she arrested the 28 year old man from Plum Street, SW in Vienna for Driving While Intoxicated and Possession of Concealed Weapon.

The driver was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated and Possession of a Concealed Weapon.

Arrest – Domestic Assault 15-011321 Cherry Circle, SW November 22 12:20 a.m. A resident reported she and her husband had been involved in a heated argument that escalated when he assaulted her.

MPO Vazquez responded and after speaking to witnesses and the victim he determined there was enough evidence to prove an assault had occurred. MPO Vazquez arrested the husband and transported him to the Fairfax County Adult Detention Center where he was charged with Domestic Assault.

Arrest – Driving While Intoxicated 15-011326 300 Block Maple Avenue, West November 22 2:05 a.m. Officer Post was on patrol when she observed the driver of a vehicle commit a series of traffic violations. As a result of those violations she conducted a traffic stop. Upon her interaction with the driver she detected the signs of possible impairment. After failing to complete a series of field sobriety tests she arrested the 29 year old man from Springfield, Virginia for Driving While Intoxicated.

He was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated.

Arrest – Narcotics Violation 15-011327 200 Block Nutley Street, NW November 22 2:05 a.m. Officer Reedy was on patrol when he observed the driver of a vehicle commit a traffic violation. As a result of that violation he conducted a traffic stop. Upon his interaction with the driver he detected the distinct odor of marijuana emanating from the vehicle. While checking the status of the driver’s operator’s license he discovered he was wanted on a Failure to Appear Warrant obtained by a Virginia Beach, Virginia police department.

After searching the vehicle, subsequent to his arrest, a measurable amount of marijuana, marijuana paraphernalia and a Schedule II Narcotic was located. The driver was transported to the Fairfax County Adult Detention Center where he was charged with the Failure to Appear from Virginia Beach, Possession of Marijuana and Possession of a Schedule II Narcotic.

He was released on an unsecured bond and transported back to his vehicle.

Animal Case 15-011345 900 Block Timber Lane, SW November 22 10:50 a.m. A resident reported she was attacked by a medium sized, black poodle mix dog while taking a walk. She stated the dog ran up to her and jumped on her causing a scratch on the rear of her leg. She was unsure if the injury was the result of being bitten or scratched.

Officer Tremont responded to the address of the suspected dog’s owner. Although the owner did not appear to be home he observed a dog matching the description given by the resident in the home.

Mental Case 15-011356 Westview Court, NE November 22 3:21 p.m. A resident reported her husband and daughter would not allow her into their residence. Officer Hylinski responded to the residence and spoke with the daughter who provided her mother, known to suffer from a mental condition, clothing and personal items needed to stay an area shelter.

Officer Hylinski transported the woman to a local church where she telephoned a taxi to take her to the shelter.

Domestic Dispute 15-011430 Westview Court, NE November 23 8:00 p.m. A resident responded to the Vienna Police Station to report his daughter-in-law, whom he had a Protective Order issued against, had arrived at his residence and was asking for her mother’s telephone number.

The resident stated he did not want his daughter-in-law arrested for the Protective Order Violation but wanted it document for court purposes.

Open Door 15-011417 Vienna Pediatrics 410 Maple Avenue, West November 24 6:20 a.m. An employee reported when she arrived at the office in the morning she discovered the door was unlocked and partially ajar.

MPO Seitz responded and searched the business finding nothing appeared to be out of place. The employee stated it was possible the cleaning company had left the door unlocked.

Natural Death 15-0011419 200 Block Cottage Street, SW November 24 8:00 a.m. A resident discovered her elderly mother deceased in her bedroom.

A Detective will follow up with this case.

Domestic Assault 15-011425 Longview Court, NE November 24 10:31 a.m. A resident reported that two of her sons were actively involved in a physical altercation in the basement of the residence. PFC Tracy responded and was informed by the resident that her sons had left the residence, when she informed them she was going to contact the police.

MPO’s Seitz and Lyons were able to locate one of the sons who stated this was a matter between the two brothers and they did not want the police to get involved.

Arrest – Drunk in Public/Petit Larceny 15-011445 Amphora Restaurant 377 Maple Avenue, West November 24 5:57 p.m.

An employee reported a Hispanic male had become disorderly and was refusing to pay his bill. The man left the restaurant prior to the arrival of the police officers.

PFC Kiley responded and located the man a short distance from the restaurant, passed out on the ground. After awakening him he determined he was intoxicated. The 32 year old man from Hillcrest Drive, SW in Vienna was arrested for Drunk in Public and transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.

The employee from the Amphora declined to prosecute for his refusal to pay the bill.

Arrest – Violation of a Protective Order 15-001147 Westview Court November 24 6:59 p.m. Residents reported their daughter-in-law had again been at the residence in violation of a Protective Order. The daughter-in-law had left the residence but continued to repeatedly telephone them, which was also a violation of the Protective Order.

Officer Reedy located the daughter-in-law at Zoe’s Kitchen, located in Vienna. The 51 year old woman from Westview Court in Vienna was arrested for Violation of a Protective Order and transported to the Fairfax County Adult Detention Center.

She was held on a $12,500 bond.
