Police: Handicapped Woman's Responsibility to Pick Up After Service Dog

For past week, unknown person has been putting dog's feces on her front porch, police say. It's among the latest crimes reported by police.

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from March 20, 2015 – March 26, 2015. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arffrest proceedings can be researched through the appropriate court’s website.

Bad Check 15-003124 Michel Rene For Hair 165 Maple Avenue, East November 5 12:00 p.m. An employee advised that their salon received a check from a customer that was written on a closed account. Attempts to reconcile this issue with the customer have been unsuccessful.

This case is being investigated.

Fraud 15-003004 300 Block Branch Road, SE February 20 10:00 p.m. A resident advised she was the victim of a fraud when an acquaintance requested she cash a check for him because he did not have a bank account. The resident agreed, deposited the check into her account and gave the acquaintance the money.

The resident was later notified by the bank that the check she cashed was stolen and they removed the money from her account. This case is being investigated.

Animal Case 15-002993 200 Block Glyndon Street, SE March 17 10:00 a.m. A resident reported that while she was walking in the area she approached a woman who was walking with a dog, described only as a black lab. As she put her hand out to greet the dog it nipped her finger.

The resident later found that she was in need of medical attention for the bite. ACO Barker is following up with this case to try to locate the dog. This information was also provided to the Fairfax County Health Department.

Animal Case 15-002964 The Hope Center 140 Park Street, SE March 17 7:00 p.m. ACO Barker received a report that an employee had been bitten by Oscar, a Miniature Dachshund. The employee advised that Oscar had been released to go home with his owner in Reston.

ACO Barker contacted the Fairfax County Animal Control who will follow up with Oscar to ensure he is properly quarantined.

Open Door 15-002907 Advanced Auto 311 Maple Avenue, East March 17 10:25 p.m. Officers responding to the report of an alarm at the business found the rear door unlocked. The officers searched the business and found everything to be in order. An employee was notified to secure the business.

Grand Larceny 15-002970 Walgreens 225 Maple Avenue, East March 19 3:05 p.m.

A citizen reported that she believes her sunglasses were stolen from her while shopping in Walgreens. The citizen advised that at one point she felt a person bump into her and believes they may have taken the sunglasses from her at that time.

The citizen further advised that she is being followed by an unknown female and believes that person may have been the one who stole her sunglasses.

Juvenile Case 15-002988 Park Terrace Court, SE March 19 9:30 p.m. A resident reported that her daughter had not returned home from school. The resident had been in telephone contact with the daughter and advised her to come home, but she refused.

During the night the resident notified the police that her daughter had returned. MPO Shaw responded to the residence and counselled the juvenile who also admitted to consuming beer.

Fraud 15-003044 600 Block Plum Street, SW March 20 12:00 a.m. A resident reported that an unknown person had used her credit card account to make purchases without her knowledge.

This case is being investigated.

Arrest – Driving While Intoxicated 15-002987 100 Block Moore Avenue, SW March 20 12:32 a.m. Officer Slebonick was on patrol when he observed a vehicle commit a series of traffic violations. As a result of those violations he conducted a traffic stop. As Officer Slebonick approached the driver he immediately smelled the odor of an alcoholic beverage emanating from his person. Upon further interaction he determined the driver may have been impaired.

After failing to complete a series of field sobriety tests he arrested the 24 year old man from Centreville, Virginia for Driving While Intoxicated.

The man was transported to the Vienna Police Station where he was given the opportunity to submit a sample of his breath for analysis, but he refused to take the test. He was then transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated and Refusal to Submit to a Breath Test and was being held without bond.

Police Service 15-002998 Vienna Volunteer Firehouse 400 Center Street, South March 20 11:32 a.m.

An unknown citizen left a bag containing an assortment of prescription bottles at the firehouse. The prescription was taken to the Vienna Police Station to be properly disposed of.

Juvenile Case 15-003016 Park Terrace Court, SE March 20 9:30 p.m. A resident reported continuous problems with her daughter leaving home without permission. The mother had received a text from her daughter stating that she would not be returning home that night, and she was concerned for her daughter’s well-being.

Officers were able to locate the juvenile at a friend’s home and found she had been drinking alcohol. The officers transported her back home and released her to her mother.

Open Door 15-003022 1400 Block Cottage Street, SW March 21 1:52 a.m. Officers responded to the report of a suspicious vehicle parked in front of an abandoned house. While checking the vehicle and the residence they found the front door of the house was unlocked. Officers checked the residence finding nothing to be disturbed.

Suspicious Event 15-003031 100 Block Patrick Street, SE March 21 9:31 a.m. A handicapped resident advised she has a service dog that she sometimes has difficulty picking up after when she allows it to defecate in the common area. For the past week an unknown person has been putting the dog’s feces on her front porch. The officer canvassed the area but was unable to locate that person.

The resident was advised that it is her responsibility to pick up after the dog, and she was counseled on the matter.

Civil Matter 15-003037 100 Block Oakmont Court, NE March 21 11:20 a.m. A resident advised of a civil matter she is having with her landlords. The resident was advised of the civil process to follow.

Found Property 15-003057 500 Block Maple Avenue, West March 21 6:27 p.m. A resident reported that he found 3 baggies containing a white powder substance, believed to be a drug, in a parking lot. The baggies were turned over to the Vienna Police Department for destruction.

Arrest – Driving While Intoxicated 15-003068 Orchard Street at Lewis Street, NW March 21 11:31 p.m. Officer Reedy responded to the report of an unconscious male in a vehicle. A citizen advised he observed the man slumped over the steering wheel and that he was able to get the vehicle’s ignition into park before calling for assistance.

Officer Reedy was able to wake the driver and immediately detected the odor of alcohol. The officer also observed a bottle of alcohol and a prescription bottle containing pills in the vehicle.

Rescue responded, assessed the driver and cleared him medically.

After failing to complete a series of field sobriety tests Officer Reedy arrested the 63 year old man from Vienna, Virginia for Driving While Intoxicated.

The man was transported to the Fairfax County Adult Detention Center where he gave consent for his blood to be drawn for analysis. He was then charged with Driving While Intoxicated and released to the Sheriff’s Deputies.

Disorderly Person 15-003088 1200 Block Cottage Street, SW March 22 1:16 p.m. A realtor reported a man acting disorderly toward her. The man returned to his home before police arrived on scene.

The realtor was advised of the warrant process if she wished to pursue charges against the man.

Suspicious Event 15-003130 1000 Block Glyndon Street, SE Between March 22 5:00 p.m. and March 23 5:00 p.m. A resident advised that when she attempted to log into Turbo Tax to file her taxes on-line she found she was locked out of her account. When she notified Turbo Tax she was informed that someone had filed taxes using her account.

The resident is following up with both the IRS and Turbo Tax.

Suspicious Person 15-003091 The Wine Outlet 278 Cedar Lane, SE March 22 6:34 p.m.

A citizen reported a suspicious male entered the business and began making unusual statements. He then left the area without further incident before police arrived. Officers searched the area but were unable to locate the person.

Police Service 15-003092 100 Block Maple Avenue, West March 22 8:13 p.m. A citizen was concerned for her husband’s safety and requested an officer conduct a welfare check in the area where he is employed. Officers found the business was closed, the building secure and everything appeared to be in order.

Animal Case 15-003093 600 Block Birch Street, SW March 22 10:14 p.m. Officer Reedy responded to the area for a dog at large that appeared to be injured or sick. He located the yellow and white dog and found it appeared to have a rear leg injury and poor vision.

Attempts to locate an owner were unsuccessful so the dog was transported to the Fairfax County Animal Shelter and left with their staff to be released to its owner.

Police Service 15-003123 1200 Block Cottage Street, SW March 23 1:46 p.m. A concerned resident requested a welfare check on his neighbor who he has not seen for the last month. Officers were unable to make contact with the neighbor but found nothing to be out of order at the residence.

Suspicious Event 15-003128 200 Maple Avenue, West March 23 3:16 p.m. A citizen came to the Vienna Police Station to report having her food stamps stolen. However, there were inconsistencies in the information given by the woman.

Suspicious Event 15-003158 1000 Block Frederick Street, SW March 24 Between 11:20 a.m. and 11:30 a.m. A resident advised he left his house for a short time, while his wife stayed in the home. While he was out his wife heard two loud bangs. When he returned home he found what he believes are pry marks on the side door of the residence.

Officers searched the residence to verify that no entry was gained and no other damage was done.

Medical – Assist EMS 15-003172 900 Block Hillcrest Drive, SW March 24 9:19 p.m. Officers responded to assist rescue with a female who fell in the tub, injuring herself. The female was transported by rescue to Fairfax Hospital for treatment.

Arrest – Driving While Intoxicated 15-003181 300 Block Maple Avenue, West March 25 12:58 a.m. Officer Herrera was on patrol when he observed a vehicle commit a series of traffic violations. As a result of those violations he conducted a traffic stop. Upon his interaction with the driver, the officer observed the driver’s behavior indicated that he may have been impaired.

Once the driver was identified the officer found that his license was currently suspended with restrictions for a previous Driving While Intoxicated offense. The restrictions authorized him to drive only under certain circumstances and with the use of an Ignition Interlock System installed. The vehicle he was driving did not have this system installed.

The driver declined the series of field sobriety tests that were offered to him. Officer Herrera arrested the 33 year old man from Fairfax, Virginia on charges of Driving While Intoxicated.

The man was transported to the Vienna Police Station where he was given the opportunity to submit a sample of his breath for analysis, however he refused the test.

The man was then transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated, Driving on a Suspended License, Violating a Court Restricted License and Refusal to Submit to a Breath Test and held on a $28,000 bond.

Grand Larceny 15-003187 McDonalds Restaurant 544 Maple Avenue, West March 25 Between 10:30 and 11:30 a.m. A customer reported that she had left her cell phone unattended and charging for a short time while she was in the restaurant. When she went to retrieve it she found it was missing and believes someone may have taken it.

Vehicle Tampering 15-003223 600 Block Blackstone Terrace, NW Between March 24 8:54 a.m. and March 25 8:54 a.m. A resident reported that an unknown person entered her locked vehicle and rummaged through her belongings. Nothing appeared to be missing and there was no damage to the vehicle.

Suspicious Event 15-003245 1200 Block Cottage Street, SW March 26 3:52 p.m. A resident advised he was walking his dog in the area when a man walking on the opposite side of the road began yelling at him in Persian.

Officers located the man who agreed to go back into his residence and stop harassing his neighbors.
