Vienna Crime: Golf Ball Sails Through Car Window, Machete in Restaurant, Stolen Coffee Mugs

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from November 7, 2014 – November 13, 2014. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

INCIDENTS
Grand Larceny 14-012633 1000 Block Ware Street, SW August 20 5:00 p.m. A resident reported that an unknown individual stole a credit card from his mailbox. The individual then activated the card and made an unauthorized purchase on it.

This case is under investigation.
Telephone Case 14-012507 100 Block Oak Street, SW October 25 4:56 a.m. A resident reported receiving two threatening telephone messages from his brother.
The process for obtaining a warrant was explained to the resident should he decide to pursue charges against his brother.
Parking Complaint 14-012411 Church Street and Center Street, NE November 6 8:22 p.m. Department of Public Works employees advised officers of three vehicles that were parked in violation of “No Parking” signs that were preventing them from completing scheduled street paving.
Officers were able to locate two of the vehicle’s owners. However, all attempts to locate the owner of the third vehicle were unsuccessful and the vehicle was towed.
Vandalism 14-012427 100 Block Wade Hampton Drive, SW Between November 6 at 11:00 p.m. and November 7 at 7:00 a.m. A resident reported that her mailbox had been vandalized by an unknown person.
Fraud 14-012600 500 Block Orchard Street, NW Between November 7 at 12:00 a.m. and November 10 at 12:00 a.m. A resident reported that an unknown person has been using his NFCU bank account to make unauthorized purchases.
This case is being investigated.
Trespass 14-012423 Whole Foods 143 Maple Avenue, East November 7 10:07 a.m. An employee advised officers of a man seated in the café area of their business who had been banned from their property a year ago.
Officers made contact with the man who appeared to be unaware that he was not welcome in the store. It was requested that he leave the area and was advised that he could be charged with trespassing if he returned. The man agreed to leave the property without any incident.
Domestic Dispute 14-012433 1000 Block Hillcrest Drive, SW November 7 3:00 p.m. A resident reported that he and his wife have been having marital issues for the past few years and he is concerned that the issues may escalate to become physical.
The resident advised he will be contacting an attorney to discuss his options.
Found Property 14-012435 Bowman House 211 Center Street, South November 7 5:51 p.m.
A citizen came in to the Vienna Police Station to turn in a house key that was found in the parking lot.
Petit Larceny 14-012495 Starbucks 207 Maple Avenue, East November 7 7:10 p.m. An employee was observing the live feed security camera in the store when he saw a male take a coffee mug and leave without paying for it. He attempted to stop the male, but he was unable to locate him once he left the store.
The employee advised the person has previously taken items from the store. Starbucks refused to pursue charges in this case.
Police Service 14-012492 200 Cedar Lane, SE November 7 11:59 p.m. A resident’s juvenile niece informed him that she witnessed her mother being physically assaulted by her boyfriend. The assault happened at their home in Fairfax County.
Officer Vazquez notified the Fairfax County Police to inform them of the situation. He then advised the resident to contact their department for further assistance. The process to obtain a warrant and protection order was also explained to them.
Arrest – Driving While Intoxicated/Refusal/Concealed Weapon 14-012450 500 Block Maple Avenue, West November 8 12:42 a.m. Officer Tremont was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment.
After failing to successfully complete one sobriety test, and refusing to take any other sobriety tests, he arrested Mr. Richard Clarence Poling, 45, of Sauerbacker Road, Pasadena, Maryland for Driving While Intoxicated. Mr. Poling was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis, which he also refused. A check for warrants indicated that Mr. Poling was wanted in Maryland for a probation violation.
Mr. Poling’s vehicle was towed from the scene of his arrest. During an inventory of the vehicle Officer Digan located two knives concealed in the vehicle, in addition to a firearm that Mr. Poling had advised the officers of. The knives were placed into the property section of the police department as evidence for the concealed weapons charge. The firearm was placed in property for safe keeping.
Mr. Poling was transported to the Fairfax County Adult Detention Center. During this transport he made threats to kill Officer Tremont. Mr. Poling was charged with Driving While Intoxicated, Refusal to Submit to a Breath Test, two counts of Concealed Weapon and Driving Without a License. He was held on a $4,000.00 bond. The Sheriff’s Department will handle the charges from Maryland.
Arrest – Narcotic Violation 14-012485 Lawyers Road and Upham Place, NW November 8 12:50 p.m. MPO Shaw was conducting a road check when he observed a vehicle with expired registration and conducted a traffic stop. Upon his interaction with the driver he smelled an odor of marijuana emanating from the vehicle and located both marijuana and drug paraphernalia.
MPO Shaw issued a summons to Cameron Craig McPhie, 23, of Leatherwood Drive in Reston, Virginia, for Possession of Marijuana. He was released on his signature.
Arrest – Driving While Intoxicated 14-012504 400 Block Maple Avenue, West November 9 1:35 a.m. While on patrol Officer Digan observed the driver of a vehicle commit a traffic violation. As a result of the violation he conducted a traffic stop. Upon his interaction with the driver he detected signs of possible impairment.
After failing to complete a series of sobriety tests he arrested Stephen Albert Hess, 60, of Tower Side Drive in Fairfax, Virginia for Driving While Intoxicated. Mr. Hess was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated where he was to be held until he was sober.
Assault 14-012505 200 Block Cedar Lane, SE November 9 5:23 a.m. A resident reported that she was awakened when one of her roommates entered her room and touched her inappropriately.
Due to conflicting statements between the two parties, the resident was advised of the process to obtain a warrant if she wished to pursue charges against her roommate.
Open Door 14-012518 300 Block Broadleaf Drive, NE November 9 4:18 p.m. Officers responded to a residential alarm. PFC Vazquez and MPO Shaw located two unlocked doors.
The property was searched and nothing appeared to be out of place. The doors were secured prior to the officers leaving the residence.
Suspicious Event 14-012520 200 Block Cedar Lane, SE November 9 6:05 p.m. A citizen reported a male running near the shopping center with a machete. Officers searched the area but were unable to locate the male.
Police Service 14-012521 1100 Block Desale Street. SW November 9 6:57 p.m. Residents expressed concern for the welfare of their adult son who has recently been suffering some medical issues.
Arrest – Alcohol Violations 14-012524 200 Block Cedar Lane, SE November 9 11:33 p.m. Officer Herrera responded for a report of a male knocking on the door to an apartment and refusing to leave. He located Mr. Miguel Padilla Argueta, 18, of Cedar Lane, SE in Vienna and found him to be intoxicated. Mr. Padilla Argueta was also found to be in possession of alcohol. He advised that his parents were refusing to allow him into their apartment.
The residents advised that Mr. Padilla Argueta becomes violent when he is drunk and they do not want him in their home in this condition.
Officer Herrera arrested Mr. Padilla Argueta on charges of Drunk in Public and Underage Possession of Alcohol. He was transported to the Fairfax County Adult Detention Center and turned over to the custody of the Sheriff’s Department.
Found Property 14-012538 100 Block Battle Street, SW November 10 11:32 a.m. A resident reported a child’s bicycle that had been left in his yard.
The bicycle is being held at the Vienna Police Station until an owner can be identified.
Suspicious Event 14-012549 Capital Energy 232 Dominion Road, NE November 10 2:53 p.m.
An employee advised that unknown people are continuously taking metal and copper that they place outside of their building.
Fraud 14-012584 500 Block Maple Avenue, West November 11 12:38 p.m. A citizen advised she purchased a vehicle from a person through Craig’s List. When she attempted to register the vehicle at the Virginia DMV she was informed that the vehicle’s title appears to have been altered.
This case is under investigation.
Police Service 14-012594 100 Courthouse Road, SW November 11 3:43 p.m. A driver reported damage to the right rear window of his vehicle as he was stopped in traffic. A golf ball was found in the back of his vehicle.
MPO Sheeran found that a resident in the 100 Block Cottage Street, SW was putting golf balls and had accidently hit a ball in the direction of the roadway. The resident was advised of the danger of hitting the golf balls towards a roadway and he agreed to pay for the damages he had caused.
Grand Larceny 14-12644 300 Block Blair Court, NW Between November 11 at 5:30 p.m. and November 12 at 6:15 a.m. A resident reported a bicycle was stolen from his unlocked vehicle that was parked in his driveway.
Arrest – Drunk In Public 14-012603 500 Block Walker Street, SW November 11 8:35 p.m. Officers responded to the report of a domestic dispute. A resident was trying to prevent her husband from driving intoxicated. Officers located the man standing next to his parked vehicle, showing signs of intoxication and he refusing to comply with the officers’ requests.
MPO Shaver arrested Henry Eugene Davis, 63, of Walker Street, SW in Vienna for Drunk In Public. Mr. Davis was transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.
Suspicious Event 14-012631 Rite Aid 215 Maple Avenue, West November 12 1:27 p.m.
An employee advised they had a customer who was trying to buy green dot cards as a result of a phone scam.
The customer stated that she received a phone call at her home in Fairfax stating that her immigration status was in jeopardy and she would be deported unless she provided payment to the caller in Green Dot cards.
Since the fraud occurred in another police jurisdiction the customer was advised of the proper authorities to file a report with.
Suspicious Event 14-012634 900 Glyndon Street, SE November 12 1:30 p.m. A resident reported an encounter she had with a man while she was walking her dogs. The resident felt the conversation was suspicious.
The man left the area before the resident contacted the police.
Suspicious Event 14-012635 400 Block Maple Avenue, East November 12 2:22 p.m. An unknown person called the police department to report he had witnessed an assault by several individuals the previous night in the 400 Block Maple Avenue, East. The caller stated the person who was assaulted was in the hospital. The caller was very vague with the information he was providing and refused to speak to a police officer in person.
Attempts to locate any further information regarding the person assaulted or the incident actually occurring were unsuccessful.
Police Service 14 -012636 Hunan Delight 276 Cedar Lane SE November 12 2:47 p.m. An employee advised a customer was in the restaurant with a machete. The customer was not disorderly and did not brandish the weapon, but the employee felt uncomfortable that the customer had the knife with him on the premises.
In the presence of the police officer, the employee asked the customer to leave the restaurant, and was advised he may be charged with trespass if he returned. The customer left the area without incident.
Trespassing 14-012638 100 Block Dogwood Street, SW November 12 4:50 p.m. A resident reported two teenagers trespassing on her property that is under construction. The teenagers fled the area when they saw the resident.
Natural Death 14-012643 400 Block Yeonas Drive, SW November 12 7:30 p.m. A resident reported that he found his elderly wife deceased in the bedroom.
A detective will follow up with this case.
Attempted Fraud 14-012669 400 Block Windover Avenue, NW November 13 1:40 p.m. A resident received a telephone call from an individual claiming to be with the IRS. The caller stated she owed the IRS money and that her property would be seized if the debt was not satisfied.
The resident did not transfer any funds or provide any information to the caller, but instead contacted the police immediately.
