Vienna Crime: North Carolina Man Charged with Rape, Strangulation in Vienna
The week in crime in the Town of Vienna, from the Town of Vienna Police Department weekly crime report.

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from August 14, 2015 – August 20, 2015. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

INCIDENTS:
Arrest – Rape/Strangulation/Domestic Assault/Preventing a 911 Call 15-007865 Cedar Lane, SE August 15 4:41 a.m. The Vienna Police Department received a complaint of a possible domestic situation. Officer Herrera and Detective Leroux responded to the apartment. The investigation resulted in the arrest of a 25 year old man from Cherryville, N.C. who was subsequently charged with Rape, Strangulation, Domestic Assault and Preventing a 911 call. In addition to those charges he was charged with Violation of a Protective Order.

He is currently held on no bond.
Computer Fraud 15-008043 100 Block East Street, NE Between January 20 at 6:00 a.m. and August 20 at 12:00 p.m. A resident reported an individual had been hacking into her computer and viewing her personal emails. The resident was reluctant to provide the identifying information of the individual on the advice of her attorney.
This case is being investigated.
Animal Case – Quarantine 15-007842 400 Block Victoria Court, NW August 06 12:00 p.m. ACO Barker received a report that a Town resident had been bitten by her dog “Dulcia”. Dulcia’s owner was informed of the quarantine process and agreed to quarantine her dog at home.
ACO Barker will follow up with this case.
Grand Larceny 15-007953 200 Block Locust Street, SE Between August 09 at 12:00 p.m. and August 17 at 12:20 p.m. A resident reported his bicycle had been stolen. He stated the Trek brand bicycle had been stored unsecured in the basement of his apartment complex.
This case is active.
Assault with Weapon 15-007833 200 Block Locust Street, SE August 13 1:00 p.m. A resident reported that two of her daughter’s male friends had been at the house when an argument broke out between the two men. The argument escalated when one of the men stabbed the other in the buttock.
MPO Vazquez, along with Detectives Leroux and Simon, responded to the residence and spoke with both men. Both gave the same account of the incident, claiming it was a mutual combat situation and neither wanted to press charges.
Trespassing 15-007845 500 Block Nutley Street, SW August 14 2:10 p.m. A resident reported her father’s ex-girlfriend had been repeatedly showing up at the residence to see her father. She stated her father no longer wishes to see the ex-girlfriend and told her on several occasions to leave and not return.
The ex-girlfriend had left the area prior to the arrival of the police.
Animal Case - Quarantine 15-007852 400 Block Welles Street, SE August 14 7:18 p.m. A citizen was dog sitting for a resident’s two dogs, “Percy” and “Oly”. She stated the two dogs became involved in a physical altercation and as she attempted to separate the two, Oly bit her on the forearm.
MPO Smith contacted Oly’s owner and informed her of the quarantine process. She agreed to quarantine Oly in her home.
ACO Barker will follow up with this case.
Suspicious Event/Loud Party 15-007858 200 Block Elm Street, SW August 14 11:55 p.m. Officer Tremont responded to a residence for the report of a loud party. Upon arriving he and Sgt. Sheeran encountered several individuals running from the residence.
Sgt. Sheeran entered the residence and collected a measurable amount of suspected marijuana and paraphernalia. The items were collected and will be held at the Vienna Police Station for destruction.
Sgt. Sheeran made several attempts to contact the homeowners but was unsuccessful.
Assist EMS 15-007875 Whole Foods 143 Maple Avenue, East August 15 11:59 a.m. MPO Vazquez responded to Whole Foods for the report of two individuals fighting over a broom. Upon arrival he spoke with a witness who stated the man was attempting to take the broom from the female. He stated the man let go of the broom and a few moments later the woman fell to the ground.
Fairfax County Rescue personnel responded to the scene and transported the woman to an area hospital as a precaution.
Suspicious Event 15-007883 300 Block Berry Street, SE August 15 2:52 p.m. An alarm company reported a residential alarm had been activated. MPO Vazquez responded and located a woman at the residence who did not appear to have the correct code to disarm the alarm.
MPO Vazquez contacted the key holder who responded to the scene and identified the woman as a girlfriend of someone who lived in the house. The homeowner informed the key holder the woman was no longer permitted in the residence.
The woman returned her keys and agreed to leave and not return.
Arrest – Domestic Assault/Strangulation/Abduction/Preventing a 911 Call 15-007886 Cottage Street, SW
August 15 6:15 p.m. A resident reported she and her son had been involved in a heated argument that escalated into a physical altercation.
Officer Herrera located the son in his bedroom and after speaking with him he transported the 36 year old man from Cottage Street in Vienna to the Fairfax County Adult Detention Center where he was charged with Abduction, Strangulation, Domestic Assault, Preventing a 911 Call and Possession of Marijuana.
He was held without bond.
Arrest – Arson 15-007891 500 Block Nutley Street, SW August 15 9:46 p.m. A resident reported that her father’s ex-girlfriend had returned to the house after being previously told by police not to return to the property (See Incident Number 15-007845 above).
MPO Smith arrived after speaking with the ex-girlfriend he located items that could be used to create in incendiary device.
The 51 year old female from Powell Lane in Falls Church, Virginia was transported to the Fairfax County Adult Detention Center where she was charged with Threatening to Burn a Dwelling and Possession of an Incendiary Device.
She was held without bond.
Medical Case 15-007901 Kramer Court, SE August 16 1:55 a.m. Officer Herrera responded to a residence to assist Fairfax County Rescue personnel with a female resident who may have been suffering from a medical emergency. After speaking with the female she informed him she did not want to be transported to a hospital and would stay with her parents for the evening.
Arrest – Forgery 15-007919 Westbriar Drive at Maple Avenue, NE August 16 1:12 p.m.
MPO Vazquez was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. During the traffic stop the driver attempted to provide his passenger’s driver’s license as his own. After that attempt failed he provided MPO Vazquez with another name and social security number that also proved to be false.
Due to the inability to positively identify the driver of the vehicle MPO Vazquez transported the 27 year old man, with no fixed address, to the Fairfax County Adult Detention Center where he was charged with Driving without a Valid Operator’s License, Using the Identifying Information of Another to Avoid a Summons, and Display or Represent as His Own a Driver’s License not Issued to Him. The man was turned over to the Sheriff’s Deputies where he was photographed and fingerprinted in order to confirm his true identity.
After leaving the Detention Center MPO Vazquez was notified by a Fairfax County Sheriff’s Deputy, that the individual’s true identity had been confirmed and he was wanted for a Failure to Appear on a Weapons charge from Maryland.
MPO Vazquez returned to the Detention Center and obtained warrants for Felony Forging a Public Record, Providing False Identification to a Law Enforcement Officer after Being Lawfully Detained, Driving without a Valid Driver’s License and Represent as His Own a Driver’s License not issued to Him.
The previous warrants issued under the false identity were withdrawn. He was held without bond.
Petit Larceny 15-007938 200 Block Glen Avenue, SW Between August 16 at 4:30 p.m. and August 17 at 9:28 a.m. A resident reported the front license plate had been stolen from his vehicle.
Police Service 15-007925 Meadow Lane at Ware Street, SW August 16 5:40 p.m. Officer Slebonick responded to assist a man and woman involved in a custody dispute concerning their child. The mother of the child stated the father was to return the child to her but the child was being resistant.
The father was given more time to speak with his son, calming him down and convincing him to return home with his mother.
Arrest – Trespassing 15-007929 Marshall Road Elementary School 730 Marshall Road, SW August 16 11:52 p.m. An alarm company reported an alarm had been activated at the Marshall Road Elementary School. Sgt. Sheeran and Officer Tremont responded and located two individuals, who had entered the school by climbing on the roof and entered through a roof hatch.
Officer Tremont issued summonses to the 20 year old man from Kings Way Court in Vienna and the 19 year old woman from Pruitt Court, SW in Vienna for Trespassing.
After signing their summonses the man and woman were released.
Suspicious Event 15-008004 200 Battle Street, SW August 18 10:06 p.m. A resident responded to the Vienna Police Station to turn in a coin purse she found in her mailbox. The purse contained a green leafy substance consistent with marijuana.
The substance will be held at the police station until it can be destroyed.
Domestic Dispute 15-008008 Patrick Street, SE August 19 12:23 a.m. A resident reported that she and her husband had been involved in a verbal argument. Officer Hylinski responded and spoke with both the husband and wife who agreed the argument had not turned physical.
The husband and wife agreed to stay in separate areas of the house for the evening to allow for a cooling off period.
Arrest – Alcohol Violation 15-008009 Lawyers Road at Malcolm Road, NW August 19 3:12 a.m. MPO Seitz was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver and her passengers, he determined a passenger in the rear seat had been in possession of alcohol and was under the age of 21.
MPO Seitz issued a summons to the 18 year old woman from Reddfield Drive in Falls Church, Virginia for Underage Possession of Alcohol. She was released after signing the summons.
Arrest – Drunk in Public 15-008026 200 Block Cedar Lane, SE August 19 10:31 p.m. Officer Herrera was on patrol when he observed an individual sitting on the ground and appeared to be asleep. After approaching the individual and waking him from his slumber he determined he was intoxicated.
Officer Herrera transported the 37 year old man from Patrick Street, SE in Vienna to the Fairfax County Adult Detention Center where he was charged with Drunk in Public.
He was to be held until he was sober.
Domestic Dispute 15-008029 Hillcrest Drive, SW August 20 12:08 a.m. A resident reported that she and her son had been involved in a verbal argument. She stated her son left the residence prior to the arrival of Officer Tremont.
The son was contacted and stated he would be staying with a friend for the evening to allow for a cooling off period.
Grand Larceny 15-008044 300 Block John Marshall Drive, NE August 20 2:45 p.m. A resident reported she had a group of “Woodchucks” performing work at her home. She stated there were three workers in all, two men and a woman. She stated the woman asked to use her bathroom and after the workers left she noticed a bottle of prescription pain medication was missing.
This case is being investigated.
