Vienna Crime: Phone Scams, Craigslist Dispute, Noise Violation
Plus accused burglary from construction site, car window smashed, dogs on the loose.
The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from July 25, 2014 – July 31, 2014. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

Some reports may be outside the date parameters due to extended investigations or other circumstances. Some cases are not included at all due to ongoing investigations. INCIDENTS
Police Service 14-08384 900 Block Fairway Drive, NE May 20 1:00 a.m. A resident reported she had been involved in legal proceedings with a dealership that resulted in her vehicle being towed. She stated that after getting her vehicle back she discovered several items had been taken.

MPO Sheeran informed her that this was a civil matter and not a matter for the police.
Grand Larceny 14-08417 Exxon Gas Station 395 Maple Avenue, East Between July 17 at 9:00 a.m. and July 18 at 9:00 a.m. A resident reported that a check had been taken from his checkbook and cashed without his permission.
This case is being investigated.
Lost Property 14-08553 1100 Block Drake Street, SW Between July 22 at 12:00 p.m. and July 23 at 12:00 p.m. A citizen reported that while staying with her son in the area a ring and a check had gone missing.
Assist Fire and EMS 14-08370 600 Block Hillcrest Drive, SW July 24 11:22 p.m. MPO Smith responded for the report of an individual that was in medical distress. Upon his arrival he was met by Fairfax County Fire and Rescue personnel who transported the individual to an area hospital for treatment.
Natural Death 14-08390 100 Block Patrick Street, SE July 25 5:30 a.m. The daughter of a resident located her deceased elderly father in the basement of his residence.
A detective will follow up with this case.
Police Service 14-08378 100 Block Battle Street, SW July 25 10:04 a.m. A resident responded to the Vienna Police Station to turn in a box of unused ammunition for destruction.
Fraud 14-08381 400 Block Wolftrap Road, SE July 25 10:51 a.m. A resident reported she had received a telephone call from an individual claiming to be her grandson. The caller stated he had been in a traffic accident in California and was requesting money for an attorney and to post his bond.
The resident recognized this as a scam and no money was sent to the caller.
Burglary 14-08387 300 Block John Marshall Drive, NE July 25 2:00 p.m. An employee for a construction company stated that when he arrived at a home that was to be razed, he encountered an individual exiting the home with a water heater. The individual stated he had been given permission to take the water heater by a worker driving a truck with an eagle on it however he was unable to provide the name of the worker or any other description.
The employee stated no one worked for his company that drives a truck with an eagle displayed.
This case is being investigated.
Case Update:
On July 31, 2014 Officer Holcombe obtained warrants and arrested Mr. John Peter Delavergne, 57, of Desale Street in Vienna for Grand Larceny and Possession of Burglary Tools.
Mr. Delavergne was transported to the Fairfax County Adult Detention Center where after being formally charged he was released on his signature.
Vandalism 14-08442 200 Block Cedar Lane, SE Between July 25 at 8:30 p.m. and July 26 at 9:06 p.m. A resident reported that the rear passenger window of his vehicle had been smashed out.
Domestic Assault 14-08401 Yeonas Drive, SW July 25 10:00 p.m. A resident reported that she and her husband had been involved in a heated argument that escalated when he shoved her.
PFC Lyons responded and spoke with the wife who informed him she did not wish for the case to be pursued. She was informed of the warrant process should she decide to pursue the case at a later time.
Telephone Case 14-08439 400 Block East Street, NE July 26 between 10:00 a.m. and 5:57 p.m. A resident reported that she and her husband had answered an advertisement on Craigslist to purchase an oven. She stated they met with the seller, who lived on a third floor apartment, and after unsuccessfully attempting to get the oven through the front door they rescinded their offer. The seller then became angry and accused them of scratching her floor.
The resident stated that since that time the seller had been repeatedly calling both their home and cell phone numbers, threatening to call the police if they did not repair the scratches.
She informed the officer she wanted a police report filed but did not wish to pursue charges.
Arrest – Drunk in Public 14-08420 100 Block Courthouse Road, SW July 26 11:07 a.m. MPO Sheeran responded to the area for the report of an individual lying in the street. Upon his arrival he located an extremely intoxicated individual who indicated, with his hand gestures and speech that he desired to be arrested. Due to his convincing argument MPO Sheeran arrested Mr. Jose Rafael Hernandez, 47, of Patrick Street, SE in Vienna for Drunk in Public.
Mr. Hernandez was transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.
Police Service 14-08421 900 Block Westwood Drive, NE July 26 11:11 a.m. A resident responded to the Vienna Police Station to turn in unused ammunition for destruction.
Suspicious Event 14-08436 Giant Food Store 359 Maple Avenue, East July 26 3:45 p.m.
A resident reported that a Hispanic male had followed her from the area of Branch Road to the Giant Food Shopping Center. She stated he attempted to engage her in unwanted conversation at which time she approached members of the Vienna Fire Department who transported her to a safe location where she telephoned the police.
Officer Reedy responded and located the individual matching the description given by the resident, sitting on a bench in front of the Giant, who stated he had attempted to strike up a conversation with the resident but nothing else had occurred.
Officer Reedy determined that no violations of law had occurred.
Fraud 14-08438 300 Block Aponi Court, SE July 26 5:41 p.m. A resident reported she received a telephone call from an individual claiming to be with Microsoft and claimed there was a problem with her computer. The resident stated the caller had taken control of her computer as evidenced by her mouse and screens being remotely manipulated.
After claiming to have fixed the problem the caller requested the resident provide a credit card number to pay for the service. After providing the information to the caller the resident was informed by a family member that she had been the victim of a scam.
She immediately cancelled the credit card and contacted the police department.
Arrest – Driving While Intoxicated 14-08449 Maple Avenue at East Street, NE July 26 11:39 p.m. MPO Shaver was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment. After failing to complete a series of field sobriety tests he arrested Mr. Stephen Brian Ritchie, 56, of Point Pleasant Drive in Fairfax, Virginia for Driving While Intoxicated.
Mr. Ritchie was transported to the Vienna Police Station where he was provided the opportunity to supply a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated.
Mr. Ritchie was to be held until he was sober.
Arrest – Drunk in Public 14-08450 East Street at Maple Avenue, NE July 26 11:56 p.m. PFC Lyons responded to the area to assist MPO Shaver with a traffic stop that culminated with the driver being arrested for Driving While Intoxicated (See Case Number 14-08449 above).
Upon arriving on the scene PFC Lyons encountered a passenger in the vehicle who began to argue with officers concerning her husband’s arrest. PFC Lyons informed her that if she remained calm, and stayed in the vehicle a taxi would be summoned to take her home. The passenger initially agreed to heed PFC Lyon’s advice however she soon became impatient and again exited the vehicle becoming argumentative and disregarding several more warnings to remain calm. Her continued behavior left PFC Lyons no alternative but to arrest Ms. Mary Catherine Ritchie, 49, of Point Pleasant Drive in Fairfax, Virginia for Drunk in Public.
Ms. Ritchie was transported to the Fairfax County Adult Detention Center where she was to be held until she was sober.
Arrest – Driving While Intoxicated 14-08453 300 Block Maple Avenue, East July 27 2:14 a.m. PFC Lyons was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment. After failing to complete several field sobriety tests he arrested Mr. Michael Jonathan Moreno, 23, of Lincoln Street in McLean, Virginia for Driving While Intoxicated.
Mr. Moreno was transported to the Vienna Police Station where he was provided the opportunity to supply a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated.
Mr. Moreno was to be held until he was sober.
Arrest – Drunk in Public/Trespassing 14-08457 1400 Block Cottage Street, SW July 27 6:41 a.m. A resident reported he had found an individual sleeping in the shed behind his residence. Officers Reedy and Holcombe responded and located the individual and after awaking him from his slumber they determined he was extremely intoxicated. As a result of his intoxication Officer Reedy arrested Mr. Jose Amilcar Sorto, 32, No Fixed Address, for Drunk in Public.
The resident informed Officer Reedy that Mr. Sorto had been previously hired to cut his lawn and was now requesting that Mr. Soto be trespassed from his property and informed that he is to never return.
Officer Reedy transported Mr. Sorto to the Fairfax County Adult Detention Center where he was charged with Drunk in Public and Trespassing.
Mr. Sorto was held on a $250.00 bond.
Arrest - Noise Violation 14-08458 400 Block Nutley Street, NW July 27 7:58 a.m. Officer Kiley responded for the report of construction workers performing work on a residence, in violation of the Town of Vienna Noise Ordinance. Upon his arrival he met with an individual who had been installing hardwood floors.
Officer Kiley determined the workers had been previously warned of the Noise Ordinance however had chosen to not abide with the warnings. Officer Kiley issued a summons to Mr. Ivan O. Calix, 34, of Essex Court in Alexandria, Virginia for Violation of the Town Noise Ordinance.
Mr. Calix was released after signing the summons.
Animal Complaint 14-08465 900 Block Country Club Drive, NE July 27 11:10 a.m. A resident reported that two dogs, without collars, had wandered into his yard.
MPO Sheeran responded and without any way to identify their owners he transported the dogs to the Fairfax County Animal Shelter where they will be held until the owners can be identified.
Domestic Dispute 14-08469 400 Block Creek Crossing Road, NE July 27 12:53 p.m. A resident reported she and her husband had been involved in a heated argument. Officer Reedy responded and determined no physical assault had occurred.
The husband agreed to leave the residence for the evening to allow for a cooling off period.
Missile at an Occupied Vehicle 14-08489 Chain Bridge Road at Glengyle Drive July 28 2:47 a.m. PFC Lyons was on patrol when he observed a juvenile throw an object at his police cruiser. The juvenile immediately fled the scene into the area of the Mosby Landing Community. MPO Shaver also responded and while checking the area he observed a group of juveniles jump a fence and then fled toward the Flint Hill area.
The officers were unable to locate the juveniles. There was no visible damage to the police cruiser.
Medical Case 14-08494 1000 Block Pickett Place, SW July 28 9:09 a.m. A resident reported that an individual had been observed falling into bushes, and staggering behind a residence.
Sgt. Farhan responded and located the individual who appeared to be in medical distress.
The Fairfax County Fire and Rescue Department was summoned and transported the individual to an area hospital for treatment.
Police Service 14-08515 The Vienna Police Station 215 Center Street, South July 28 5:52 p.m. A citizen responded to the Vienna Police Station after she received a telephone call from a police officer with a Chicago Police Department. The officer informed her that she needed to respond to a police station and provide proof that she and her daughter were in good health and not in danger.
PFC Vazquez contacted the Chicago Police Department and informed them the citizen was safe.
Medical Case 14-08516 500 Block Orchard Street, NW July 28 6:40 p.m. A resident reported that his daughter was in need of medical attention. PFC Vazquez responded and assisted Fire and Rescue personnel as they prepared to transport the daughter to an area hospital for treatment.
Police Service 14-08545 The Vienna Police Department 215 Center Street, South July 29 10:57 a.m. Lt. Marsh received a telephone call from the Fairfax County Police Department regarding information of a possible crime that may have occurred several years ago.
Lt. Marsh investigated the accusation and determined no criminal activity had occurred.
Grand Larceny 14-08567 Whole Foods Market 143 Maple Avenue, SE July 29 between 4:00 p.m. and 5:42 p.m. A resident reported that while she was shopping at the Whole Foods Market she discovered her wallet had been stolen. While the resident was on the telephone cancelling a credit card she was informed the credit card had been used at several area businesses.
This case is being investigated.
Petit Larceny 14-08592 100 Block Park Street, NE July 30 between 8:50 a.m. and 9:30 a.m. A citizen reported that someone had stolen the license plates from her vehicle while it was parked in the area.
Police Service 14-08607 100 Block Patrick Street, SE July 30 7:26 p.m. A resident reported that his wife may have been in need of medical treatment. MPO Shaver responded and after speaking with both the husband and wife he provided them transportation to and area hospital for treatment.
Medical Case 14-08654 200 Block Cedar Lane, SE July 31 5:09 p.m. A resident reported that his wife was possibly in need of medical treatment.
MPO Sheeran responded and after speaking to the wife she informed him that she was not in need of treatment. MPO Sheeran offered options in the event her condition changed.
Trespassing 14-08655 100 Block St. Bernard Drive, NE July 31 6:44 p.m. A resident reported that a neighbor had been on his property and was refusing to leave. The resident stated that he and his neighbor had been having a long standing dispute over several issues.
PFC Lyons responded and spoke with the both individuals. The resident requested his neighbor be informed he was to leave the property and not return. The neighbor was explained and stated he understood the trespass law.
Open Door 14-08657 500 Block Spring Street, SE July 31 7:43 p.m. A resident reported that the rear door to a neighbor’s residence had been left open. MPO Sheeran and Officer Tracy responded and searched the residence and found nothing appeared to have been disturbed.
The homeowner was contacted and made arrangements for someone to respond to secure the door.
CRASHES
100 Block Park Street, SE 14-08558 July 29 3:57 p.m. The driver of the first vehicle was traveling north bound on Park Street approaching Maple Avenue and stopped to make a left turn onto Maple Avenue, SE
The driver of the second vehicle was traveling in the lane of travel when he stated he fell asleep and rear ended the first vehicle.
The driver of the second vehicle was issued a summons for Failure to Pay Full Time and Attention.
Nutley Street near Courthouse Road, SW 14-08610 July 30 9:40 p.m. The drivers of two vehicles were traveling north bound on Nutley Street, in the same lane of travel, when they stated that two deer entered the roadway.
The driver of the first vehicle slowed to avoid the deer however the driver of the second vehicle was unable to stop and rear ended the first vehicle.
