Vienna Crime: Runaway Grocery Cart, Obscene Phone Calls, DWIs

The week in crime based on Vienna Police Department's police report issued Friday.

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from October 17, 2014 – October 23, 2014. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

INCIDENTS

Fraud 14-11620 900 Block Plum Street, SW May 06 12:00 p.m. A resident reported an unknown person used his Wells Fargo Debit Card to purchase a Western Union money order without his knowledge.

This case is being investigated.

Suspicious Person 14-011597 Navy Federal Credit Union 820 Follin Lane, SE Between September 24 at 9:00 a.m. and October 15 at 9:00 a.m. An employee reported his concern about the statements and behavior an ex-employee made while employed at the Credit Union.

The ex-employee had been trespassed from the property.

Fraud 14-011852 The Women’s Center 133 Maple Avenue, NE Between September 28 at 9:00 a.m. and October 22 at 3:20 p.m. An employee reported she was contacted by her bank in reference to suspicious charges that were made on the business credit card. She stated the charges were made without her knowledge.

This case is being investigated.

Animal Case 14-011637 The Hope Center 140 Park Street, SE October 12 12:00 p.m. ACO Barker transported a deceased Golden Retriever from the Hope Center to the Fairfax County Animal Shelter to be tested for Rabies. The dog and owner reside in Fairfax County.

The Fairfax County Health Department will follow up with this case.

Lost Property 14-011697 The Fresh Market 150 Branch Road, SE Between October 15 at 9:00 a.m. and October 18 at 12:16 p.m. A citizen reported she had lost her wallet while shopping at the Fresh Market.

Lost Property 14-011631 Marco Polo Restaurant 245 Maple Avenue, West Between October 15 at 8:00 p.m. and October 16 at 8:04 p.m. A resident reported she had lost her wallet while attending an event at the Marco Polo Restaurant.

Police Service 14-011654 Vienna Police Station 215 Center Street, South October 17 12:09 p.m.

A resident came to the Vienna Police Station to turn in unused ammunition for destruction.

Animal Case – Quarantine 14-011752 Animal Scan 328 Maple Avenue, East October 17 1:00 p.m.

ACO Barker received a report that an employee had been bitten on the hand while attempting to perform a medical procedure on a cat. The employee stated the cat was released to its owner who resides in Washington, D.C.

The Washington Humane Society will follow up with this case.

Domestic Dispute 14-011665 300 Block Branch Road, SE October 17 2:30 p.m. A resident reported that she and her mother had been involved in a heated argument.

Officer Reedy responded and spoke with the mother who wanted her daughter to leave the residence and not return. The mother was informed of the eviction process should she wish to pursue having her daughter removed from the residence.

The argument had not turned physical.

Destruction of Property 14-011667 Giant Shopping Center 359 Maple Avenue, East October 17 3:45 p.m.

A citizen was in her vehicle when a runaway shopping cart, traveling at a high rate of speed, made contact with her driver’s side mirror, causing it to fold in, then struck her door. She stated the cart continued to bounce between her vehicle and the shopping cart return barrier as it fled through the parking lot.

Fraud 14-011771 100 Block Melody Lane, SW Between October 18 at 8:00 a.m. and October 20 at 8:00 a.m. A resident reported that her adult son had used her credit card to pay his cell phone bill without her permission.

The son stated his mother paid the bill and denied taking the credit card.

This case is being investigated.

Domestic Dispute 14-011703 400 Block Wolftrap Road, SE October 18 2:10 p.m. A resident reported she and her elderly husband had been involved in an ongoing argument concerning his care.

Officer Holcombe responded and suggested the wife contact other family members to assist with the care of her husband.

Police Service 14-011710 100 Block Melody Lane, SW October 18 8:45 p.m. MPO Shaver responded to assist with transporting a resident to an area hospital.

Trespassing 14-011713 500 Block Malcolm Road, NW October 18 10:14 p.m. Officer Tracy was on patrol when he observed a group of juveniles in the Peterson Lane Park in violation of the No Trespassing after Dark Ordinance. Upon his interaction with the juveniles he learned that they had come from the Homecoming Dance at James Madison High School and had parked in the area waiting to go to a party.

After speaking with the juveniles he also determined that one was in possession of alcohol and another was in possession of a small quantity of marijuana.

After counseling the juveniles on the consequences of alcohol, marijuana use and trespassing after dark the juveniles were released to a responsible adult.

Medical Case 14-011718 Roland Street at Carter Street, SW October 19 1:11 a.m. Sgt. Farhan was on patrol when he observed a Fairfax County Police Officer conduct a traffic stop. After speaking with the Fairfax County Officer, Sgt. Farhan learned the driver of the vehicle had been in an argument with her son and was attempting to get him into her vehicle to take him to an area hospital.

Sgt. Farhan and the Fairfax County Officer were able to persuade the son to return to the vehicle.

Arrest – Driving While Intoxicated 14-011722 Nutley Street at Hermosa Drive October 19 1:42 a.m. Sgt. Farhan was on patrol when he observed the driver of a vehicle traveling at a high rate of speed. As a result of the speed he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment.

After failing to complete a series of field sobriety tests he arrested Mr. Oscar Christopher Rodriquez, 25, of Tiffin Place in Fairfax, Virginia for Driving While Intoxicated. Mr. Rodriquez was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated (2nd Offense).

Mr. Rodriquez was held on a $2,500.00 bond.

Arrest – Driving While Intoxicated/Refusal/Drunk in Public 14-011727 Nutley Street at Kingsley Road, SW October 19 5:57 a.m. PFC Kiley was on patrol when he was flagged down by an off duty Fairfax County Fire Fighter, who informed him of a disabled vehicle and an agitated driver. PFC Kiley located the vehicle with two blown out tires and a deployed airbag. Upon his interaction with the driver and the passenger he detected the signs of possible impairment.

After failing to perform a series of field sobriety tests he arrested the driver Mr. Guido Aquino- Rocha, 31, of Southampton Drive in Silver Spring, Maryland for Driving While Intoxicated.

The passenger Ms. Olivia Battazar, 27, No Fixed Address, was arrested for Drunk in Public.

Both Mr. Aquino-Rocha and Ms. Battazar were transported to the Vienna Police Station where Mr. Aquino-Rocha was given the opportunity to provide a sample of his breath for analysis. After several failed attempts to provide the sample Mr. Aquino-Rocha and Ms. Battazar were transported to the Fairfax County Adult Detention Center.

Mr. Aquino-Rocha was charged with Driving While Intoxicated and Refusal to Submit to a Breath Test and was to be held until he was sober.

Ms. Battazar was charged with Drunk in Public and was to be held until she was sober.

Officers canvassed the area where the vehicle was located but were unable to determine where the vehicle may have sustained the damage.

Burglary 14-011731 300 Block Orchard Street, NW October 19 8:55 a.m. A resident reported someone had entered a residence that had previously been owned by his uncles. The resident was unable to state if anything had been taken and did not wish to pursue a further investigation.

The resident requested extra patrols in the area.

Arrest – Driving While Intoxicated 14-011744 Maple Avenue at Glyndon Street, NE October 19 11:19 p.m. Officer Tracy was on patrol when he observed the driver of a vehicle commit a series of traffic violations. As a result of those violations he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment.

After failing to perform a series of field sobriety tests he arrested Mr. Augusto Ribeiro, 55, of Wortham Crest Circle in Manassas, Virginia for Driving While Intoxicated. Mr. Ribeiro was transported to the Vienna Police Station where he was given the opportunity to provide a sample of his breath for analysis. After the analysis he was transported to the Fairfax County Adult Detention Center where he was charged with Driving While Intoxicated.

Mr. Ribeiro was held on a $5,000.00 bond.

Suspicious Event 14-011765 200 Block Lawyers Road, NW October 20 3:15 p.m. Sgt. Juelharte responded to the Vienna Police Station to speak to a citizen who reported an incident involving another driver at the Vienna Post Office. She stated the incident began on I-66 and ended at the Post Office where the driver of the other vehicle followed her.

She stated once at the Post Office they both walked inside, as they were walking she asked him what he was doing, he cursed at her and then went about his business.

Sgt. Juelharte informed the citizen to contact the police if she saw him in her neighborhood.

Police Service 14-011772 100 Block Patrick Street, SW October 20 6:22 p.m. PFC Vazquez responded to the area in reference to a resident who wished to have his brother’s girlfriend removed from the residence.

PFC Vazquez informed the resident that in order to have the girlfriend removed he would have to follow the proper eviction process.

Animal Case 14-011795 100 Block Moore Avenue, SE October 21 6:04 a.m. A resident reported that a neighbor’s dogs had been barking continually for about a half hour and it was disrupting his children.

Officer Digan responded and attempted to contact the owner of the dogs but was unsuccessful. ACO Barker will follow up with this case.

Animal Case – Quarantine 14-011798 Oakton Vienna Animal Hospital 320 Maple Avenue, East October 21 8:00 a.m.

ACO Barker was requested by the Health Department to transport Gertrude, the cat, to the Health Department to be tested for Rabies. Gertrude had passed away during her quarantine period for a previous bite to a human.

Telephone Case 14-011808 Gamestop 203 Maple Avenue, East October 21 10:44 a.m.

An employee reported she had been receiving degrading and obscene telephone calls from an unknown number.

Officer Herrera informed her to contact the police if the telephone calls continued.

Domestic Dispute 14-011818 Maggio’s Restaurant 421 Maple Avenue, East October 21 1:05 p.m.

A citizen reported that she and her husband had been involved in a heated argument.

Officer Herrera responded and spoke with both parties who confirmed the argument had not turned physical and agreed to handle any further issues civilly.

Open Door 14-011832 Al Nakheel Café 340 Maple Avenue, West October 22 1:44 a.m.

An alarm company reported that a business alarm had been activated. PFC Vazquez responded and located an open door. After searching the business he determined nothing appeared to be out of place.

The door was secured prior to leaving.

Arrest – Narcotics Violation 14-011859 Ross Drive at Cottage Street, SW October 22 11:41 p.m. Sgt. Farhan was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver and passenger he detected the distinct odor of marijuana emanating from the vehicle.

After further interaction he located a measurable amount of Marijuana and drug paraphernalia.

Sgt. Farhan issued a summons to Mr. Anthony Wayne Cameron, 19, of Tyson Oaks Circle in Vienna for Possession of Marijuana and Mr. Tayvon Maleek Timmons, 18, of Tysons Landing Court in Mclean, Virginia for Possession of Drug Paraphernalia.

Mr. Cameron and Mr. Timmons were released after signing their respective summons.

Vandalism 14-011885 200 Block Charles Street, SE October 23 between 1:00 p.m. and 5:05 p.m. A construction worker reported that when he returned to his vehicle at the end of the day he discovered a window had been damaged.

CRASHES

Tapawingo Road at Cottage Street, SW 14-011630 October 16 7:27 p.m. The driver of the first vehicle was traveling east bound on Tapawingo Road, SW. The driver of the second vehicle was traveling north bound on Cottage Street, SW.

Both drivers felt they had the right of way and entered the intersection causing a collision.

Maple Avenue near Beulah Road, NE 14-011671 October 17 4:57 p.m. The driver of a vehicle was attempting to back out of a parking spot, while looking at her cell phone, and backed into a building.

Lawyers Road at West Street, NW 14-011704 October 18 2:11 p.m. The drivers of three vehicles were traveling north bound on Lawyers Road, NW, in the same lane of travel. The driver of the first vehicle in line stopped to make a left turn onto West Street, NW. The drivers of vehicles two and three also stopped.

The driver of the fourth vehicle made a right turn off Church Street onto north bound Lawyers Road and rear ended the third vehicle in line causing that vehicle to strike the second vehicle which rear ended the first vehicle.

200 Block Berry Street, SE 14-011716 October 19 12:37 a.m. The owner of a legally parked vehicle returned to find her vehicle had been struck by an unknown vehicle.

Maple Avenue at Pleasant Street, SW 14-011838 October 22 7:59 a.m. The driver of the first vehicle was traveling west bound in the left most lane of Maple Avenue, SW.

The driver of the second vehicle was attempting to make a left turn onto Maple Avenue from Pleasant Street, SW and collided with the first vehicle.

The driver of the second vehicle was issued a summons for Failure to Yield the Right of Way.

500 Block Maple Avenue, West 14-011867 October 23 10:02 a.m. The driver of the first vehicle was traveling east bound on Maple Avenue and had passed the intersection with James Madison Drive when he stated he was struck by a vehicle making a U- Turn in the intersection.

The driver of the second vehicle stated she was traveling west bound on Maple Avenue and had completed her U-Turn when the driver of the first vehicle switched into her lane and collided with her vehicle.

Church Street near Center Street, North 14-011886 October 23 6:40 p.m. The drivers of two vehicles were traveling east bound on Church Street, North. The driver of the first vehicle stated he missed his turn into a parking lot and stopped to back up and backed into the second vehicle.

SCAM ALERT

Note to Citizens – Recently there have been reports of callers claiming to be employees of the IRS. The callers claim the resident has either committed tax fraud or had improperly filed previous tax returns. The caller informs the resident to send a Western Union payment or purchase a prepaid debit card, for payment, or the resident will be arrested. This type of call is a scam. Never send a payment unless you have verified the validity of the caller
