Vienna Crime: 'Sexting' Case, Prescription Fraud, Car Collides with Ambulance

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from December 05, 2014 – December 11, 2014. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

INCIDENTS
Telephone Case 14-013571 300 Block Tapawingo Road, SW Between August 01 at 12:00 p.m. and December 10 at 11:28 p.m. A resident reported she had been receiving harassing and sexually explicit texts from an individual since August. She stated she normally ignores the messages and has blocked the number but they have continued.

MPO Shaw contacted the individual who had been sending the texts. He informed MPO Shaw that the two of them met in Connecticut and that she had given him her number. He stated he would delete her number and cease any further attempts to contact her.
Suspicious Event 14-013386 100 Block James Drive, SE November 14 12:00 p.m. A resident reported she had been contacted by an on-line company for employment. The terms of her employment were to accept packages, repackage them and then send them on to addresses specified by her employer. All correspondence took place through email.
After completing several shipments without being compensated the resident became suspicious and contacted the police department.
This case is being investigated.
Medical Case 14-013377 Suntrust Bank 501 Maple Avenue, West December 04 10:45 p.m. Officer Holcombe responded to assist a citizen who requested he be transported to an area hospital.
Arrest - Driving While Intoxicated 14-013382 600 Block Pine Street, SE December 05 1:18 a.m. Officer Reedy was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the driver he determined he may have been impaired.
After failing to complete several field sobriety tests Officer Reedy arrested Mr. Wayne Joseph Schell III, 23, of Malraux Drive in Vienna for Driving While Intoxicated. Mr. Schell III was transported to the Fairfax County Adult Detention Center where he was given several opportunities to provide a sample of his breath for analysis. After failing to provide a sample he was given the opportunity to provide a blood sample for the analysis which he agreed to supply. After providing a blood sample Mr. Schell III was charged with Driving While Intoxicated (2nd in 10 Years)
Mr. Schell III was held on a $2,000.00 bond.
Lost Property 14-013388 The Vienna Community Center 120 Cherry Street, SE December 05 between 9:30 a.m. and 10:45 a.m. A resident reported she had lost her “Fit Flex-Bit” while exercising at the Community Center.
Police Service 14-013389 400 Block Park Street, SE December 05 12:30 p.m. A resident responded to the Vienna Police Station to turn in unneeded firearm parts that had been found in his father’s basement.
The parts will be held for destruction.
Prescription Fraud 14-013392 Vienna Drug Center 150 Maple Avenue, West December 05 3:26 p.m.
An employee reported that two male individuals entered the pharmacy and attempted to pass prescriptions that had been reported as fraudulent by the doctor listed on the prescriptions. Both individuals left the pharmacy prior to the arrival of the police officer.
This case is being investigated.
Domestic Dispute 14-013407 Westview Court, NE December 05 10:38 p.m. A resident reported that he and his wife had been involved in a heated argument concerning family issues.
Officer Digan responded and after speaking with both the husband and wife he determined that no physical altercation had occurred.
The husband and wife agreed to spend the night in separate rooms to allow for a cooling off period.
Domestic Assault 14-013417 Branch Road, SE December 06 8:44 a.m. A resident reported that she and her adult daughter had been involved in a heated argument that escalated when the two began pushing each other.
MPO Evans responded and spoke with both the mother and her daughter and determined there were no signs of injury to either person. The mother explained that she wanted MPO Evans to remove her daughter from the residence and inform her that she was no longer permitted in the home.
MPO Evans informed the mother of the proper eviction process required to have her daughter removed from the residence.
Police Service 14-013419 Navy Federal Credit Union 820 Follin Lane, SE December 06 11:08 a.m. An employee reported a customer had entered the bank and while attempting to order checks for a bank account the employee was alerted that the customer had been flagged for previously writing fraudulent checks.
The customer informed the employee that the previous incident was an error and he was attempting to clear up that problem.
Domestic Dispute 14-013426 Hillcrest Drive, SW December 06 6:09 p.m. A resident reported that she and her adult son had been involved in a heated argument.
Officer Digan responded and determined that no physical altercation had occurred. The son agreed to leave his mother’s home and return to his home in Fairfax City.
Fraud 14-013445 300 Block George Street, SW December 07 5:01 p.m. A resident reported she had been contacted by her bank concerning an attempted fraudulent charge to her credit card account. The resident verified the attempted charge had been made without her knowledge.
The bank cancelled her credit card and no successful fraudulent charges had been made.
Arrest – Drunk in Public 14-013447 Panera Bread 136 Maple Avenue, West December 07 6:10 p.m.
Officer Digan responded to the Panera Bread parking lot for the report of a female who fell while walking in the parking lot and may have been intoxicated.
Upon his arrival Officer Digan located the female sitting in a grassy area. After his interaction with the female he determined she was intoxicated and arrested Ms. Chak Chui Chu, 41, of 59th Avenue in Oakland Gardens, New York for Drunk in Public.
Ms. Chu was transported to the Fairfax County Adult Detention Center where she was to be held until she was sober.
Police Service 14-013448 600 Block Manor Drive, NE December 07 8:05 p.m. A resident responded to the Vienna Police Station out of concern for their elderly neighbor who they had not heard from or seen since Thanksgiving. The residence requested that a police officer respond to the residence and check on the welfare of the resident.
Prior to responding to the residence Sgt. Juelharte received a telephone call informing her that the elderly resident had been contacted and found to be safe.
Arrest – Narcotics Violation 14-013453 Maple Avenue at East Street, SE December 08 12:12 a.m. Officer Herrera was on patrol when he observed a vehicle with defective equipment. As a result of the defective equipment he conducted a traffic stop. Upon his interaction with the driver he detected the odor of alcohol and marijuana. After further interaction he determined the driver was not impaired however he was in possession of a measurable amount of marijuana.
Officer Herrera issued a summons to Mr. Michael Bruce Shearer, 22, of Clyde Court in Vienna for Possession of Marijuana.
Mr. Shearer was released after signing the summons.
Juvenile Case 14-013458 Cedar Lane School 101 Cedar Lane, SW December 08 between 8:00 a.m. and 10:00 a.m. An employee reported that a student had entered a classroom that she was not to be in and was disrupting the school process.
MPO Sheeran and Officer Reedy responded and were able to convince the student to go along with them to the principal’s office where she was released to her caretaker to go home for the remainder of the day.
Found Property 14-013463 1100 Block Desale Street, SW December 08 8:53 a.m. Officer Holcombe responded to the area for bicycle that had been abandoned. The bicycle will be held at the Vienna Police Station until the owner can be identified.
Juvenile Case 14-013471 Cedar Lane School 101 Cedar Lane, SW December 08 1:12 p.m. Officer Reedy responded to the area to assist school employees with a student who had walked off school grounds without permission.
Officer Reedy located the student who informed him he had left the school after becoming involved in an altercation with another student. The altercation caused him to be very agitated.
Officer Reedy was able to calm the student down and returned him to the school where they will deal with the situation internally.
Found Property 14-013480 1000 Block Hillcrest Drive, SW December 08 5:40 p.m. A resident reported a bicycle had been abandoned on the street in the area.
The “Next” brand BMX style bicycle will be held at the Vienna Police Station until the owner can be identified.
Suspicious Person 14-013482 100 Block Patrick Street, SE December 08 7:28 p.m. An anonymous caller reported a Hispanic male had approached a female and appeared to be harassing her.
PFC Lyons responded and located an individual matching the description of the Hispanic male. After speaking with the man PFC Lyons was unable to locate any female that he may have been in contact with and the original caller had left the area.
PFC Lyons counseled the male on his behavior and convinced him to go in his home as he was making his neighbor’s uncomfortable.
Animal Case - Quarantine 14-013496 The Hope Center 140 Park Street, SE December 08 10:30 p.m.
An employee reported that she had been bitten by a dog while attempting to perform a medical procedure. The employee stated the dog was unable to be saved.
ACO Barker transported the dog to the Fairfax County Animal Shelter where it will be tested for Rabies.
Petit Larceny 14-013513 Panera Bread 136 Maple Avenue, West December 09 3:30 p.m. A resident reported she had left her purse unattended at her table while she went to use the restroom. She stated when she returned she discovered her wallet had been taken.
This case is being investigated.
Vehicle Tampering 14-013560 500 Block Delano Drive, SE December 10 between 4:30 p.m. and 6:59 p.m. A resident reported someone had entered her unlocked vehicle and went through things leaving them strewn about the vehicle. She stated nothing appeared to have been taken.
Welfare Check 14-013584 Wilmar Place, NW December 11 9:02 p.m. Officer Herrera responded to a residence to check the welfare of two juvenile girls and their mother. While approaching the residence he was able to hear yelling between the mother and her daughters. Upon his interaction he determined that although a verbal argument had been going on there were no signs or reports of physical violence.
Business Alarm 14-013562 Westwood Country Club 800 Maple Avenue, East December 10 9:27 p.m. An alarm company reported the alarm to the Westwood Country Club had been activated. Officer Digan along with MPO Smith responded and after checking all ground level doors determined that nothing appeared out of place.
CRASHES
Maple Avenue near Berry Street, SE 14-013563 December 04 11:15 p.m. The owner of a vehicle discovered an unknown vehicle had struck his legally parked vehicle.
Maple Avenue at Pleasant Street, SW 14-013384 December 05 6:51 a.m. The driver of the first vehicle was traveling east bound on Maple Avenue, West. The driver of the second vehicle was traveling north bound on Pleasant Street, SW.
The driver of the second vehicle stopped at the stop sign at Maple Avenue and then proceeded to turn onto Maple Avenue and collided with the first vehicle.
The driver of the second vehicle was issued a summons for Failure to Yield the Right of Way at a Stop Sign.
Maple Avenue at Beulah Road, NE 14-013393 December 05 5:05 p.m. The driver of a Fairfax County Ambulance was traveling with the lights and siren activated when the driver of a second vehicle entered the intersection and collided with the ambulance.
The driver of the second vehicle was issued a summons for Failure to Yield to an Emergency Vehicle.
Church Street at Lawyers Road, NW 14-013421 December 06 1:44 p.m. The driver of the first vehicle was traveling west bound on Church Street and stopped for the stop sign with Lawyers Road, NW.
The driver of the second vehicle was traveling east bound on Church Street and also stopped for the stop sign with Lawyers Road, NW. The driver of the second vehicle mistakenly thought the driver of the first vehicle had motioned him to enter the intersection and collided with the first vehicle.
Maple Avenue at Lawyers Road, NW 14-013422 December 06 2:58 p.m. The driver of the first vehicle was traveling west bound on Maple Avenue, West and stopped for the red traffic signal at Lawyers Road, NW.
The driver of the second vehicle was traveling east bound on Maple Avenue and stopped for the red traffic signal in the left turn lane. The driver of the second vehicle attempted to make the left turn onto Lawyers Road, NW however the left turn green light had turned to red prior to him completing his turn. The driver attempted to clear the intersection and collided with the driver of the first vehicle.
The driver of the second vehicle was issued a summons for Failure to Obey a Traffic Signal.
Maple Avenue near Park Street, SE 14-013442 December 07 3:06 p.m. The drivers of two vehicles were traveling east bound on Maple Avenue. The driver of the first vehicle stopped due to the traffic signal beginning to turn red.
The driver of the second vehicle attempted to change from the right lane into the left lane and rear ended the first vehicle.
The driver of the second vehicle was issued a summons for Failure to Pay Full Time and Attention.
300 Block East Street, NE 14-013469 December 08 12:33 p.m. The driver of a vehicle was traveling south bound on East Street, NE when the driver of a second vehicle, traveling north bound, crossed over the dividing line causing the driver of the first vehicle to swerve and collide with a legally parked vehicle.
Nutley Street near Maple Avenue, SW 14-013498 December 09 10:05 a.m. The drivers of two vehicles were traveling north bound on Nutley Street, SW in the same lane of travel. The driver of the first vehicle slowed due to heavy traffic. The driver of the second vehicle stated he was attempting to get something out of his center console and when he returned his attention to the roadway he rear ended the first vehicle.
The driver of the second vehicle was issued a summons for Failure to Pay Full Time and Attention.
100 Block Maple Avenue, East 14-013512 September 09 4:01 p.m. The drivers of two vehicles were traveling west bound on Maple Avenue, East in the same lane of travel. The driver of the first vehicle stopped due to traffic. The driver of the second vehicle stated she was unable to stop due to the wet roadway conditions and rear ended the first vehicle.
Park Street at Church Street, NE 14-013558 December 10 5:57 p.m. The drivers of two vehicles were traveling on Church Street and stopped for the stop sign at Park Street, NE.
The driver of the first vehicle stated the driver of the second vehicle bumped his vehicle. The driver of the second vehicle denied bumping the first vehicle.
Nutley Street near Windover Avenue, NW 14-013559 December 10 6:01 p.m. The driver of a vehicle was traveling south bound on Nutley Street, NW when he stated a small animal darted out in front of his vehicle, startling him, causing him to swerve to the right and strike a legally parked vehicle.
The driver of the vehicle was issued a summons for Reckless Driving.
