DOCUMENTS: Family of Slain Guard in Lakewood Wal-Mart Shooting Files Suit Against State

The family of a Loomis Armored Cars security guard killed during a is suing the state.
The Estate of Kurt Husted - along with Wilbert Pina, a bystander who was seriously injured during the shooting - allege that the state failed to adequately supervise the shooter, Calvin Finley.
Beginning in 2006, Finley was in and out of prison and jail for multiple crimes, including violation of a protection order. The lawsuit alleges that the Department of Corrections failed to supervise and arrest Finley - a person it deemed likely to commit a violent crime - for failing to report to his corrections officer in the three months leading up to the June 2, 2009 robbery that occurred just outside of University Place.

Pina was waiting in line with his 1-year-old child when the bullet that killed Husted, 38, struck him.

Pina spoke during a press conference at his attorney's University Place office.
“I have a bullet in my shoulder that caused damage to Kurt,” he told The News Tribune. “Someone should be held responsible for this.”
