District Court Judge Joanne Jannik is currently presiding over Holloway's case.
“We are still gathering information from the arrest and will be looking forward to a hearing to move this along,” Tuscaloosa defense attorney Jason Neff told Patch. “There’s no evidence at this time of anything other than personal use and no drug distribution.”
Neff added that Holloway plans to request a hearing to review his suspension from the University of Alabama, with hopes that it can be scheduled after spring break.
Holloway, a 21-year-old junior from Charlotte and the Crimson Tide’s second-leading scorer, was arrested Monday after agents with the West Alabama Narcotics Task Force executed the search at his residence he shares with his girlfriend in 400 block of 30th Avenue East in Tuscaloosa.
According to a copy of the deposition and charge sheet obtained by Patch, agents knocked on the door and were met by Holloway before contact was made with Holloway’s girlfriend in the bedroom of the apartment.
Both of them were read Miranda at 8:45 a.m. and both waived their rights.
Agents commenced to searching the residence and found loose marijuana and a vacuum-sealed bag with marijuana in it in the living room.
Marijuana was also recovered from a TV entertainment stand, along with a rolling tray, packaging material, and Promethazine in the drawer.
Agents reports that the promethazine did not have Holloway’s name on it.
In Holloway’s bedroom, agents also located marijuana in a backpack in the closet, marijuana in a suitcase next to a shoe rack, cash in a jacket pocket, and a rolling tray with marijuana on it under the bed.
In the spare bedroom, agents found a box with marijuana in it in the closet, and marijuana in the top drawer of a dresser.
Holloway told investigators that he wanted to remain silent, but then stated that "he only smokes."
The West Alabama Narcotics Task Force said the total weight of the marijuana located in the residence was 964 grams, which is approximately 2.1 pounds.
Agents also said possession of drug paraphernalia and prescription-required medication will be presented to the grand jury.
His bond was set at $2,500 for the possession charge and $2,500 for the tax stamp charge.
Patch reported that university officials subsequently confirmed Holloway had been removed from campus pending an investigation by the Office of Student Conduct and he is not currently with the team.
Holloway’s absence comes at a critical moment for Alabama, which is preparing to open NCAA Tournament play on Friday.
The junior guard was averaging 16.8 points per game ahead of his suspension.
"We had to suspend him pending the investigation by the UA Office of Student Conduct," Alabama head coach Nate Oats said Monday during a radio interview. "We're disappointed in his behavior. With that said, we still love him. He's still our guy. We're going to get him the help that he needs."
