Mary Turner, the defense attorney for Miles, said their team was not surprised by the indictment, based on the reality that a person accused of a crime is not allowed to present any evidence to the Grand Jury.
"We are nonetheless disappointed that the Government presented this case to the Grand Jury as Capital Murder considering the evidence uncovered during our investigation and the obvious weaknesses in the Government's case brought to light during the preliminary hearing," she said.

During the preliminary hearing, details were provided accusing Davis of using a handgun provided by Miles in the incident that resulted in Harris being shot and killed.
This followed a minor altercation on The Strip with Harris' boyfriend.
The defense has argued that Miles, Davis and Alabama basketball player Jaden Bradley feared for their safety in the moments prior to the shooting, which prompted Miles to ask Tide forward Brandon Miller — the designated driver that night — to bring him the gun he had left in the vehicle.
Miller's car was struck twice during the shooting. The reigning SEC Player of the Year and Freshman of the Year, Miller has reportedly cooperated with the investigation and is not expected to face charges.
