Short Term Rental Ordinance Available To View

A stringent new proposed ordinance is now available to read on the city of Malibu's website.

MALIBU, CA — The text of the revised interim short-term ordinance drafted by the Planning Commission is now available online to view.

If the Council approves the ordinance next Monday, it will again be debated on Aug. 24 for final approval. A permanent ordinance that will supersede the interim ordinance will first be heard by the Planning Commission on Monday, and will then go before the council in September. If approved, the ordinance would go into effect Jan. 15, 2021.

The proposed ordinance, which is modeled after a short-term rental ordinance in Santa Monica, would establish a short-term rental permit system requiring different types of permits for three different categories of host: primary residents, non-primary residents, and multifamily units.

It would limit individuals to one active permit, require a 24-7 contact to address any issues, establish maximum occupancy rates based on the number of beds, prohibit on-street parking, and require hosts to have a valid permit. Citations for violations would be either $1000 per day or violation, or twice the short-term rental’s daily rental rate per day – whichever is higher.

Permits could be denied or revoked for any number of reasons, including: the property has code violations; owners are either behind on Transient Occupancy Tax payments or have falsified their application in any way; the property received more than two citations for violation of the noise ordinance within a twelve-month period (number of citations vary depending on the type of permit.)

If a permit is revoked, a property cannot be rented again for 12 months.

Non-primary residents would only be allowed to rent their properties between April 1 and Sept. 30. Multifamily units would be limited to a maximum of two units rented.
