Murder Charges Filed After Assault Victim Dies

The victim was assaulted during a family disturbance, according to San Jose police.

SAN JOSE, CA — A man who was injured in an assault last November during a family disturbance in San Jose died Saturday, police said Wednesday.

Baltazar Rudolph Espinoza, 65 of San Jose, was pronounced dead Saturday at a hospital. The Santa Clara County Coroner's Office conducted an autopsy and ruled his death a homicide, police said.

On Friday, Nov. 10, 2017 at 7:32 p.m., San Jose police officers responded to a report of a family disturbance at a home in the 400 block of Buena Vista Avenue.

At the scene, officers found Espinoza on the ground. He was taken to the hospital with life-threatening injuries, police said.

Police investigated and determined that Espinoza was assaulted by his sister's boyfriend, 50-year-old Daniel Gonzales of San Jose. Gonzales was arrested and booked into the Santa Clara County Jail on an unrelated parole violation, police said.

On Saturday, after Espinoza was pronounced dead from his injuries, detectives amended Gonzales' booking charge to homicide, police said.
