Marin Credit Firm Agrees to Pay 18 Workers $51K in Owed Overtime Wages

The 18 employees will together receive $51,860 in back wages, officials said.

A San Rafael credit card company has paid 18 employees more than $51,000 in back wages after the U.S. Department of Labor determined it failed to pay its workers the required hourly rate for overtime, federal officials said Friday.

Investigators of the department’s Wage and Hours Division agreed that the Central Payment Co. LLC, at 2350 Kerner Blvd. in San Rafael, paid company workers a salary regardless of the hours they worked and incorrectly classified them as exempt from overtime, officials said.

The employees should have received time and a half in pay for the hours they worked beyond a 40-hour work week, according to the division.

The 18 employees will together receive $51,860 in back wages, division officials said.

Under federal labor laws, even employees who are working on a salary can be due overtime pay if they work beyond a 40-hour work week and it is up to the employer to learn about minimum wage and overtime requirements based on their employees’ job duties, according to the Susana Blanco, the division’s director in San Francisco.
