Wilton Seeks Dismissal of Second Von Kohorn Molestation Lawsuit
The town believes that it is immune from liability for discretionary acts in the performance of public duties.

WILTON, CT --- Attorneys for Wilton and the Board of Education have filed a motion for summary judgment in the second lawsuit against Eric Von Kohorn that alleges the former Miller-Driscoll School paraprofessional molested a preschool child.
The complaint, filed Oct. 14, 2016, on behalf of a 4-year old student at Miller-Driscoll, alleges Von Kohorn took photographs of the boy while his pants were down in the bathroom. A 2012 complaint alleged Von Kohorn had sexually molested a girl student in the preschool.
The memorandum in support of the motion for summary judgment asserts, in part, that Wilton is immune from liability for discretionary acts in the performance of public duties, and that the duty to supervise school children is a discretionary governmental duty.

Van Kohorn was released from prison in October 2017, after serving two years of a six-year suspended sentence on a count of illegal possession of child pornography in the second degree.
Jury selection and trial are currently set for Oct. 24.
