33-Month Sentence Levied Against DC Man Who Protested Against Million MAGA March In 2020

A D.C. man with previous felony convictions was sentenced to 33-months in prison for bringing a revolver to the Million MAGA March in 2020.

WASHINGTON, DC — A District man, who was arrested for inciting violence and possession of a firearm during the November 2020 Million MAGA March, pleaded guilty in federal court Wednesday on the weapons charge and an assault charge stemming from an incident that occurred the following May, according to court documents.

Kenneth Wayne Deberry, 40, of Southwest was arrested along with three other people around 4 p.m., on Nov. 14, 2020. Police say the four were working collaboratively to disrupt the first amendment demonstration, which was supporting President Trump's false claim that he had won the 2020 presidential election.

Deberry was charged with disorderly conduct, inciting violence, aggravated assault, and being a felon in possession of a firearm, according to police

When the Metropolitan Police Department arrested Deberry, they found him in possession of a .38-caliber revolver, according to court documents. Due to earlier felony convictions in the District, including robbery and sexual abuse of a child among others, Deberry was barred from carrying a firearm, according to authorities.

On home detention pending his trial, Deberry got into a fight with a family member on May 14, 2021. The victim was taken to the hospital and treated for multiple injuries, including a collapsed lung, fractured ribs and a broken nose, according to authorities. Deberry was arrested and remained in custody until his trial.

In October 2021, Deberry pleaded guilty in U.S. District Court for the District of Columbia to the weapons charge and simple assault. As part of a plea deal, the November 2020 assault and disorderly conduct charges were dismissed.

Judge Tanya S. Chutkan sentenced Deberry on Wednesday to 33 months in prison on the weapons charge, with an additional 180 days for the May 2021 assault.
