PARDON ME: Biden Issues a Record 1,538 Executive Clemencies

President Joe Biden released a list of 39 pardons and 1,499 commutations of sentences Thursday, setting the record for presidential clemencies in a single day.

The White House described the majority of those pardoned as having committed “nonviolent drug offenses.” The list did not go into detail on specific crimes.

The pardon list includes Mikhail Zemlyansky, a Long Island, New York, man who committed a $35 million fraud. New York City’s WNBC-TV reported prosecutors called it “the largest single no-fault car insurance fraud scheme ever prosecuted.”

John Paul Garcia’s name also appears on the list. The Las Vegas Optic’s jail log from July 26 reports Garcia was booked into the San Miguel County Detention Center for battery on a household member, despite the White House describing his crime as a “nonviolent offense.”

The president is reportedly considering issuing preemptive pardons to President-elect Donald Trump’s political opponents, some of whom could include Dr. Anthony Fauci and former Rep. Liz Cheney, R-Wyo.

“America was built on the promise of possibility and second chances,” Biden said in a White House press release.

“As president, I have the great privilege of extending mercy to people who have demonstrated remorse and rehabilitation, restoring opportunity for Americans to participate in daily life and contribute to their communities, and taking steps to remove sentencing disparities for nonviolent offenders, especially those convicted of drug offenses.”

Trump promised he is “going to be acting very quickly” to pardon those imprisoned from the Jan. 6 protests in an interview with NBC’s “Meet the Press” on Sunday.

Joe Biden on Dec. 1 granted his son, Hunter, a “full and unconditional pardon” for every federal offense that Hunter committed or may have committed from Jan. 1, 2014, through Dec. 1 of this year. That reneged on the promise the elder Biden made multiple times that he would not pardon his son.

Biden concluded his statement on Thursday’s clemency list by stating, “My administration will continue reviewing clemency petitions” over the coming weeks. He leaves office on Jan. 20.

Media outlets across America were headlining Joe Biden's announcement Thursday that he has granted a couple dozen more pardons and hundreds and hundreds of commutations.

But one headline getting attention was that about Biden's grant of clemency for a couple of Chinese spies, and the fact Biden did it without making any announcement.

The Biden family links to China long have been the subject of speculation about their extent, and their impact on his presidential decisions. Son Hunter Biden once traveled to China with then Vice President Biden and came back with a multi-million dollar business deal.

The secret clemency acts were described by the Federalist.

"X user Nick Sortor posted that 'Joe Biden just pardoned multiple Chinese spies and an individual convicted of possessing child p*rnography. WHY?'" charged the report, which noted Biden "did it quietly only days before Thanksgiving."

"While most Americans were finalizing their menus and getting into the holiday spirit, Biden commuted the sentence of Yanjun Xu on November 22. Xu was convicted in 2022 for 'conspiracy to commit economic espionage; conspiracy to commit trade secret theft; attempted economic espionage by theft or fraud; attempted theft of trade secrets by taking or deception.'"

Biden's conclusion, as he said in his pardon, was, "it is in the national interest that the term of imprisonment related to the aforesaid conviction not be served in its entirety."
Xu was told to leave the U.S. and never return.

"Similarly, spy Ji Chaoqun was convicted of 'conspiracy to defraud the United States; impersonating agents of foreign governments; statements or entries generally,'" the Federalist report said.

He had arrived in the U.S. in 2013, later enlisting in the U.S. Army Reserves under a program for those with "special skills."

Federal authorities in Illionois said, "Ji worked at the direction of high-level intelligence officers in the Jiangsu Province Ministry of State Security, a provincial department of the Ministry of State Security for the People's Republic of China."

Biden commuted the sentence, with the Chicago Sun-Times confirming it was "with no fanfare or public announcement."

The report continued, "Even more disturbing, Biden also granted clemency to Shanlin Jin, who was convicted after 'police found more than 47,000 images and videos of child pornography in his computer.'"

The Financial Times suggested the executive actions were "part of a prisoner swap" involving Mark Sweden, Kai Li and John Leung. However, such swaps typically are promoted by the president making them.

Part III - Additional Information with Analysis

The convicted Dixon, IL comptroller that was among those Biden gave clemency to is a Democrat.

In a sense, much that is being revealed now has been known or reported previously. There were years of reports that indicated that there was corruption in or near the heart of Biden (D) and his time in office, which presumably Kamala Harris (D) and Barack Obama (D) knew about. The example below is from over a year ago.

So, there are better and poorer sources of news and information.

Among the many problematic areas during the Biden-Harris term of office has been its handling of the housing crisis. As several of the articles in this Patch series documented and revealed, the short version is that they made the U.S. housing crisis worse.

One of my areas of expertise is affordable manufactured housing, which has more impact on the U.S. economy than may at first be realized. While he was still Senator Joe Biden (DE-D), Biden co-sponsored the Manufactured Housing Improvement Act of 2000 (a.k.a.: MHIA 2000, MHIA, 2000 Reform Law, 2000 Reform Act). That law was widely bipartisan. Yet, after then-President William Jefferson "Bill" Clinton (D) signed the law into effect, the law has apparently not been properly implemented, as Democratic lawmakers pointed out years ago. Failure to enforce that law during the Biden-Harris term of office is documented in a report linked below.

There are some things that simply can't be attributed to bad judgment. They are apparently intentional actions.

Using housing as an example, HUD's own researchers said early in the Biden-Harris (D) term of office. Pamela Blumenthal and Regina Gray (the screen grab below is just of part of their report, more is found at the link here and the link below), but it captures key points they made.

HUD's researchers said above in part: "For more than 50 years" the causes and cures for the affordable housing crisis has been known. We reported early in this series that a wealthy player in this space who is a Manufactured Housing Institute (MHI) member - Frank Rolfe - bluntly declared that 'special interests don't want to solve the affordable housing crisis.' Ironically, he is arguably one of those special interests. So, as Rolfe pointed a finger, three proverbial fingers were pointing back at him.

But for now, the takeaway is simple and troubling.

The powers that be that pay for hundreds of millions of dollars collectively for political campaigns like the status quo. They do not want to solve the housing crisis. While millions are harmed, a smaller number are profiting from and like the current situation.

Former and future President Trump has promised positive changes. The Manufactured Housing Association for Regulatory Reform (MHARR) has reached out early in this transition process. As political independents, this writer for this Patch plans to monitor and report accordingly as we see what Eric Scott Turner, the Trump-transition candidate to be the next HUD Secretary, takes office and begins his work.
