Planned Mixed-Use Tower Next to Buckhead Theatre Back on Track

Developers have sought some zoning adjustments and will begin construction as soon as the adjustments are approved and permits are issued.

The multi-story apartment tower and associated retail development proposed adjacent to the Buckhead Theatre is coming closer to fruition following delays caused by a title dispute.

According to BuckheadView, The Hanover Co. has asked the City of Atlanta for a special administrative permit for the site of their planned 352-room, 22 story mixed-use development at 3116 Roswell Road. Hanover will begin construction as soon as it receives approval for zoning adjustments and the requisite building permits, BuckheadView said.

Patch first reported about the development in early October, but a title dispute caused by an old parking agreement caused a delay in the sale of the property.

The Loudermilk Cos., who in 2014 owned land on which a parking garage was planned to be built in 2005 wanted to sell the land for $10 million to Hanover, but an agreement between the original developers of the planned parking garage and longtime Buckhead real estate power George Rohrig threw a wrench into the works.

According to a complaint filed in federal bankruptcy court, Rohrig claimed the 2005 deal allowed him to block the sale despite the fact that the property had changed hands several times since 2005 without Rohrig’s involvement. Hanover refused to pay Loudermilk a $600,000 earnest payment due to the Rohrig agreement.

The matter was settled out of court in December of 2014 with Loudermilk and Rohrig agreeing to split around a dozen sites worth $25 million in various locations across the city, BuckheadView said.

With the legal issues out of the way, construction is expected to begin soon. During the construction process, the parking lot for the Buckhead Theatre will be inaccessible. Hanover has offered to arrange offsite parking for theatre events. Following the completion of the project, the parking lot would be re-opened to Buckhead Theatre patrons.

Buckhead CID leaders have approached Hanover about adding additional parking to their proposed design to give residents more opportunities to park their vehicles in the area. The CID would compensate developers for the additional parking they work into their projects.
