Buford Woman Arrested for Murder in Husband's Shooting Death (Update)

Police responded to a domestic dispute call Thursday night at the Preston Hill Apartments on Buford Drive.

Police have identified the victim and revealed some details surrounding the Thursday night fatal shooting at a Buford Drive apartment, apparently during a domestic dispute.

Police said Cory Smith, 34, of Buford, was found dead of a gun shot wound in his apartment at 2910 Buford Drive shortly after 9 p.m. His wife, Annette Smith, 36, has been charged with felony murder and aggravated assault.

Police believe the couple was in the process of a divorce.

“The homicide investigation has revealed that there was an argument taking place between Annette and Cory at Cory’s apartment” Gwinnett Police spokesman Cpl. Deon Washington said in a news release. “At some point during the argument, Annette produced a firearm and shot Cory. There is no indication at this point that there was a physical altercation between the two that led to a firearm being introduced.”

Annette Smith was being held without bond in the Gwinnett County Jail.

Police said the couple lived together with three children at 744 Roxholly Walk in Buford until Cory Smith moved out in mid-January of 2015 due to a Family Violence Order. Gwinnett Police twice responded to domestic disputes reported by Annette Smith in January, and the county sheriff’s office also served civil papers twice to the same address, the news release stated.

“Gwinnett County Superior Court records showed that Annette was granted a TPO against Cory on January 22, 2015,” Washington said in the news release. “One of the provisions in that TPO required that both parties have no contact with one another.”

The couple have two children together and one from a separate relationship — ages 7, 9 and 12. The children are staying with the mother’s family. Police said DFACS wlll be involved in the placement of the children.

Police have arrested and charged a Gwinnett County woman in the Thursday night shooting death of her husband at a Buford Drive apartment.

The shooting happened Thursday night at the Preston Hill Apartments at 2910 Buford Drive, an area just south of the Mall of Georgia. Police responded to a domestic dispute call at 9:14 p.m.

Olivia Annette Smith, 36, was arrested and charged with felony murder and aggravated assault, police spokesman Cpl. Deon Washington said. She was booked in the Gwinnett County jail around 1 a.m. She is being held without bond.

The name of the man and specifics of the incident have not been released.

Police say the couple were married but believed to be in the process of a divorce. The man lived in the apartment; Smith lived at another address in Buford.

“Details about what the suspect and victim were arguing about are unknown,” Washington said.
