Trim's Motion For New Trial Will Be Heard in July

A motion filed by the attorney of a former Cherokee County School Board member for a new trial will be heard next month.

Court documents show a hearing to consider the motion filed by Brian Steel, attorney for Kelly Trim, is scheduled for 1:30 p.m. Wednesday, July 15 in Courtroom 2A at the Cherokee County Justice Center.

Michael Dupont, the attorney for Trim’s husband, Robert, has joined the motion for a new trial.

The Trims, along with fellow co-defendant Barbara Knowles, were found guilty of lying to Canton police when they accused Cherokee Superintendent of Schools Dr. Frank Petruzielo of trying to run them over in downtown Canton after a contentious June 2013 school board meeting.

The trio were sentenced by Cherokee Superior Court Judge Ellen McElyea to serve 60 days in jail and 10 years on probation, but McElyea in July 2014 granted the three defendants an appeal bond, which allows them to remain out of jail pending an appeal.

The conviction forced the former Kelly Marlow to resign from the Cherokee County School Board District 1 seat.
