Ready to Be Done With Your Divorce?

Some Couples Can Bypass a Lengthy Litigation Process with Mediation

In Georgia, divorce cases can languish in court for months and even years. Many families cannot really wait that long to be able to move forward - children continue to grow up and legal fees also continue to grow while the case is pending. Further, the courts are interested in the cases on their dockets moving as quickly as possible to closure.

Mediation in divorce is a national trend, and Georgia courts follow suit. Many courts will order parties in divorce cases to participate in mediation in an attempt to reduce the number of legal issues it may have to adjudicate (if any). Why? It works.

Mediation is a way that parties to a divorce can resolve all or some of the legal issues of divorce (and other issues, such as college tuition and more). Thus, the parties set the terms, not a judge. This provides the parties with greater control over the outcome and the time-frame for the divorce.

So, when couples are ready to be done with the divorce process, they may be able to meet with a Mediator and work on solutions to achieve a settlement that can be filed as an uncontested divorce or to resolve a pending case. At a mediation appointment, the Mediator helps the parties focus their attention on the issues in a private setting that has few distractions from the tasks at hand. Attorneys often accompany their clients to mediation, though some are willing not to attend so long as they are involved in reviewing the tentative terms before any agreement is signed by the parties.

Divorce mediation can be a way for spouses to create action plans (when things will happen and how), settle the legal issues that will be submitted to the court, and more. In short, mediation keeps the parties in control of their diverging destinies and in a manner that often is faster (and often cheaper) than going all the way through the litigation process.
