License Revoked for LITH Sgt. Suspected of Driving Drunk in Fatal Crash

WALWORTH COUNTY, WI - A Wisconsin judge has revoked the driver’s license for a Lake in the Hills police sergeant accused of driving drunk and striking and killing a pedestrian in Lake Geneva, Wis., in December.

Mark Mogan, 49, of Hebron, refused a field sobriety test, Breathalyzer and to provide a blood sample following the Dec. 27 crash, but Lake Geneva police officers testified during a hearing this past week they smelled intoxicants on Mogan’s breath, according to the Janesville Gazette.

Mogan was driving a vehicle that struck Samantha Norris, 29, of Lake Geneva while she crossed the road at Edwards Boulevard and State Highway 120 in Lake Geneva, according to the Northwest Herald.

A Walworth County judge on Wednesday ruled there was probably cause Mogan was drunk and ordered Mogan’s license be revoked for a year and also ordered he undergo mandatory alcohol and substance abuse assessment and install an ignition interlock device, according to the Daily Herald.

Norris, who worked in food service at Grand Geneva Resort and was described as an avid walker who "walked everywhere she went," died two days after the crash happened at Freodert Hospital in Milwaukee, according to her obituary.

Larry Steen, Mogan’s attorney, said officers also testified Mogan’s speech and balance was normal following the crash, according to the Janesville Gazette.

“There was no poor driving,” Steen said. “The accident would have happened to any of us if we had been driving at the same locality as Mr. Mogan. The evidence shows the pedestrian should not have been in the crosswalk.”

Mogan is next expected in court on March 16 for a hearing to decide whether criminal charges should be filed against the police sergeant, according to the Daily Herald. Mogan is currently on paid administrative leave as the investigation continues into the crash.

Mogan is also a trustee on the Hebron Village Board. He is running for village board president in the April 4 election against current village board president John Jacobsen.
