SILVER SPRING, MD — A Silver Spring man charged with first degree murder in the fatal shooting of a Shell Station clerk earlier this month was found to be not mentally fit to stand trial, according to news reports.

During a bond hearing on Monday, Montgomery County State’s Attorney John McCarthy said that 31-year-old Torrey Moore was "a danger to others," according to WTOP.

Moore will remain in police custody without bond so that he can undergo further psychiatric evaluation, WTOP reported. In six months, he will face a second competency hearing.

Police responded around 3:03 p.m., on Dec. 8 for the report of a shooting at the Shell Station (Dash In convenience store) located in the 11100 block of New Hampshire Avenue.

Officers found the convenience store clerk, later identified as Wondimu, suffering from a gunshot wound. He was pronounced dead at the scene, according to police

Through their investigation, detectives identified Moore as a suspect in the case and traced him to the Enclave Apartments, which are located across the street from the crime scene, according to the report.

While executing a search warrant on Moore's apartment, police discovered the badly decaying body of a pregnant woman. The victim was later identified as 26-year-old Denise Middleton. Police say that Moore had killed Middleton sometime last October.

In addition to the charges already levied against Moore in the Wondimu case, police charged him with first-degree murder for Middleton, first-degree murder for the death of a viable fetus, and a crime of violence against a pregnant person.

Moore is due back in court on Jan. 6 for a preliminary court hearing in the Womdimu case, but WTOP reported that McCarthy didn't expect that date to stand when they present the case to a grand jury. Likewise, Moore still needs to be arraigned on the Middleton charges.
