Falmouth Family Files 1st Lawsuit In MA Apple Store Crash

FALMOUTH, MA — A Falmouth family is the first to file a lawsuit related to the fatal Hingham Apple Store crash, according to multiple media reports.

The crash resulted in multiple broken bones and other injuries for Matthew Timberger, 21, of Falmouth. Doug Sheff, an attorney for the family, has filed the first of what is expected to be multiple lawsuits coming from his office, according to CBS Boston.

Bradley Rein, 53, was arrested at his home in Hingham on Nov. 21 after driving his car through the front of the store, injuring 20 people and killing one. He pleaded not guilty to a charge of reckless homicide, as well as reckless operation of a vehicle.

Rein told investigators his right foot got stuck on the gas pedal, and tests showed he was not intoxicated at the time of the crash, according to reports. He was granted $100,000 bail on the condition that he neither drive nor leave the state without permission.

Timberger's lawsuit doubles down on those charges, alleging that Rein drove the car negligently, and also targets Apple and the store's property owners for failing to have sufficient barriers, according to an Associated Press report.

The incident occurred about 10:45 a.m., when first responders received multiple 911 calls from the Derby Street Shoppes, where the store is located.

The victim was identified by law enforcement as Kevin Bradley, 65, of New Jersey. He was pronounced dead at the scene, officials said.

Apple released a statement saying it was “devastated by the shocking events at Apple Derby Street today and the tragic loss of a professional who was onsite supporting recent construction at the store.”

“Our hearts go out to our team members and customers who were injured and all of those who were affected by this terrible incident,” the company said.
